Sec. 2-20.01. - Position created.

There is hereby created the position of Chief Deputy District Attorney.

Sec. 2-20.02. - Term of office: Removal.

The Chief Deputy District Attorney shall serve at the pleasure of the District Attorney; provided, however, the Chief Deputy District Attorney shall have not less than fifteen (15) days' notice in writing of the District Attorney's intention to remove him before his removal shall become final. During such fifteen (15) days, he may be suspended or relieved of his duties by the District Attorney.

Sec. 2-20.03. - Powers and duties.

Under the supervision of the District Attorney, the Chief Deputy District Attorney shall have the following powers and duties:

(a)

Assist in the development and implementation of goals, objectives, policies, and priorities;

(b)

Assist with the planning, assigning, supervising, and reviewing of the work of the District Attorney's office;

(c)

Serve as senior trial attorney;

(d)

Supervise the handling of the felony and misdemeanor case load;

(e)

Confer with the Sheriff's office and outside law enforcement agencies regarding the legal aspects of law enforcement activities;

(f)

Receive complaints filed by arresting officers or complainants and review and examine the evidence, interrogate witnesses, and determine whether or not a crime has been committed, the nature of the crime, whether or not the evidence justifies prosecution, and determine the appropriate charges;

(g)

Assist in investigations to secure evidence or in the conduct of investigations;

(h)

Review and assist in the preparation of search warrants;

(i)

Appear on behalf of the prosecution at all court hearings;

(j)

Prepare pleadings, motions, and briefs;

(k)

Do legal research and review and evaluate court decisions and legislation to determine the effects on law enforcement activities;

(l)

Confer with the Grand Jury and advise regarding the legal aspects of criminal investigations;

(m)

Appear before and present evidence to the Grand Jury regarding felony indictments;

(n)

Evaluate staff performance;

(o)

Perform administrative supervisory duties in the areas of Family Support, Public Administrator, and Public Guardian;

(p)

Assist the District Attorney's office staff with difficult and unusual problems:

(q)

Assist in the budget preparation and administration;

(r)

Prepare written reports and correspondence;

(s)

Coordinate the legal aspects of law enforcement activities with other County departments and outside agencies;

(t)

Supervise and train the assigned staff; and

(u)

Serve as acting District Attorney as assigned.

The salary of the Chief Deputy District Attorney shall be as set by the Board.
