2.100.290 - Compensation schedule.

Except as otherwise provided in this chapter, all officers and employees of the county shall receive the compensation provided in the standard salary schedule for the position classification in which each is employed. Such compensation shall be paid on a biweekly basis. The salary pay period shall begin on a Saturday and end fourteen days later on a Friday, and shall consist of eighty working hours. Such pay periods will be as established by the auditor-controller. Employees, including elected officials, shall be paid each Friday following the conclusion of a pay period, or as otherwise provided by the board of supervisors. The treasurer-tax collector shall pay such warrants upon presentation thereof.

2.100.300 - Errors in pay.

A. If, due to an error, the county fails to pay an employee for time in excess of two hours which was completely and correctly recorded on his certified and timely submitted time card, the auditor-controller shall, normally within three workdays after notification of the error by the employee's department, but not later than five workdays thereafter, issue, manually or otherwise, a warrant for the balance of pay due the employee.

B. For purposes of this section, an error shall only mean an error made by the office of the auditor-controller or management information services in processing or producing a payroll warrant.

C. Errors made in the accrual of vacation, sick leave, or other similar paid leave shall be corrected during the following salary pay period or as soon thereafter as possible.

2.100.310 - Standard salary schedule.

A. Standard salary schedules shall indicate the equivalent biweekly, hourly, and monthly rates appropriate for the salary range and steps of each range for salary payment purposes. The salaries listed on the table and index shall be the basis from which the standard salary schedules are derived. The ranges from the standard salary schedules are converted to annual amounts for salary computation purposes. The methods of determining the hourly, biweekly, and monthly amounts are as follows:

  1. The hourly rate is derived by dividing the annual salary amount by two thousand eighty hours and rounded to the nearest cent.

  2. The biweekly rate is derived by multiplying the hourly rate by eighty hours and rounded to the nearest cent.

  3. The monthly rate is derived by dividing the annual salary amount by twelve.

B. The standard salary schedule may be established and revised from time to time by resolution of the board of supervisors.

2.100.320 - Basic salary schedule for permanent employees—Part time.

The biweekly salary calculation for persons working less than full time in positions listed on the departmental allocation list shall be derived by multiplying the regular hourly rate for the employee's class times the actual number of hours worked (or authorized hours off in a pay status) during the biweekly pay period.

2.100.330 - Merit step increase.

A. Merit step salary increases shall not be deemed automatic, but shall be awarded only to those employees whose overall performance appraisal meets county standards (i.e., is at least satisfactory), on recommendation of the department head, provided, however, that prospective merit step increases can be terminated at any time by resolution of the board of supervisors.

B. Except as hereafter provided, the first merit step increase within range may be granted on the first pay period following completion of thirteen full pay periods of service in a budgeted position. This applies to employees who have completed thirteen pay periods of satisfactory service as new employees with the county, or after a promotion pursuant to Section 2.100.340, or after reclassification pursuant to Section 2.100.390. However, the first merit step increase within the range may be granted to employees initially appointed above Step A of the salary range only following completion of twenty-six full pay periods of service in a budgeted position.

C. An employee shall be eligible for subsequent merit step increases until said employee reaches the maximum salary step of the appropriate salary range. The employee shall be eligible for each increase twenty-six pay periods after his last merit step increase and said effective date shall be at the beginning of a pay period.

D. Two pay periods prior to each employee's salary anniversary date, the department head shall submit to the county auditor-controller the appropriate payroll form advancing the employee to the next higher step of the range. Such notification shall constitute authorization for the county auditor-controller to make payment to the employee at a higher rate as hereinabove provided. If the employee's anniversary date is overlooked through an error, and upon discovery of the error, the employee is recommended for a merit step increase, the county auditor-controller shall honor a supplemental payroll compensating the employee for the additional salary he would have received from his salary anniversary date; provided, however, that the department head may at his discretion recommend that the employee be advanced to the next step of the salary range at any time subsequent to said employee's salary anniversary date. In the event a new salary anniversary date shall be established for the purpose of merit step increases, that shall be the effective date of the step increase.

E. Step increases of eligible department heads shall be granted only upon approval of the county administrator.

F. All appointive officers serving for a term governed by the provisions of Article II, Section 5, of the California Constitution shall receive increases within range as provided in subsection (A) of this section, without specific authorization of the board of supervisors.

2.100.340 - Salary on promotion.

A. Except as provided in subsection (B), any employee who is appointed to a class having a higher salary range than the class which he formerly occupied shall receive the nearest higher biweekly salary not less than one full step in the new salary range as of the date upon which the promotion becomes effective. Such promotion may be either inter or intra departmental. In such case, the employee shall receive a new salary anniversary date.

B. Upon recommendation of the human resources director and the approval of the county executive officer, an employee may be appointed to a higher salary step than that provided in subsection (A) where the employee is deemed by the department head to be entitled to a commensurately higher step or when he is being restored to a position which he formerly held in the same department.

C. When an employee who is occupying a flex-staffed position is promoted, the employing department shall submit the payroll document to the human resources department one pay period prior to the effective date of such promotion. If, through an error, the employing department fails to submit the payroll document to the human resources department in a timely manner, the county auditor-controller shall nevertheless honor the original intended effective date of such promotion provided that the payroll document is submitted not later than Friday of the sixth biweekly pay period past the original intended effective date of such promotion. The employee's salary anniversary date shall be adjusted accordingly.

2.100.350 - Effective date of salary changes.

As regards to any salary change resulting from the application of Sections 2.100.340, 2.100.360, 2.100.370, 2.100.380 or 2.100.390 of this code, such salary change shall be effective the first day of the biweekly pay period in which the change occurs.

2.100.360 - Salary on demotion.

Any employee who is demoted to a position in a class having a salary range lower than the class of position from which he was demoted shall have his salary reduced to the monthly salary next lower than the salary he received before demotion. In such cases the employee shall retain the same anniversary date.

2.100.370 - Salary on transfer.

Any employee who is transferred from one position to another or from one department to another shall be compensated at the same step of the salary range as he previously occupied, if such transfer is to the same class or to another class having the same salary range, with no change in anniversary date.

2.100.380 - Changes in salary allocation.

The salary of an employee who has permanent status in a class which is reallocated to a new salary range shall be determined as follows with no change in anniversary date:

A. If the class is reallocated to a higher range, the employee shall be compensated at the step in the new salary range as he was occupying in the range to which the class was previously allocated.

B. If the position is reallocated to a lower salary range, the employee shall continue to receive the same compensation he received in his former class on the effective date of such action with no change in anniversary date.

2.100.390 - Salary on position reclassification.

The salary of the incumbent of a position which is reclassified shall be determined as follows:

A. If the position is reclassified to a class which is allocated to the same salary range, the salary of the employee shall not change and neither shall his anniversary date.

B. If the position is reclassified to a class which is allocated to a higher salary range, the salary of the employee shall be the nearest higher monthly salary in the new range of the date upon which the reclassification is effective, and this date shall be the new anniversary date of said employee.

C. If the position is reclassified to a class which is allocated to a lower salary range, the salary of the employee shall not change and there will be no change in anniversary date.

2.100.400 - Board authority to specify salary.

Notwithstanding anything in this chapter to the contrary, the board of supervisors may, by resolution, upon recommendation of the county administrator, specify that new employees, or the incumbent of a particular position, occupy a step on the salary range for that class either higher or lower than that provided for elsewhere in this chapter. Moreover, the board of supervisors may, by the position allocation resolution, specify that certain classes shall have a recruitment step at a range other than the first.

2.100.410 - Salary payment procedure.

A. A salary range or amount shall be set for every classification listed in the table and index; such salary shall be paid to the person holding such position unless otherwise specifically authorized by the board of supervisors. Such compensation shall be paid on a biweekly basis, or as otherwise provided by the board of supervisors.

B. Compensation for each officer, board, commission, assistant deputy clerk, attache and other employees in the service of the county shall be paid out of the county general fund, or such other fund as may be provided for by ordinance or by law. Whenever an employee shall have been discharged by the head of his/her department, or otherwise terminated his/her service, payroll certification of such discharge or termination by the head of such department shall immediately be filed with the personnel director and county auditor-controller. Upon receipt of such notification, the auditor-controller shall draft a warrant for the period of time and/or pay due said employee up to the time of discharge, with payment being made on the first pay day following the week separation occurs.

C. At a time designated by the county auditor-controller the head of each department shall certify on forms designated by the auditor-controller, that to the best of his knowledge, each employee reported correctly his/her time to the county as required by law. Said department head shall subscribe his/her name to the designated forms. If there is any exception as to any employees, the department head shall so state on the submitted forms.
