2.31.010 - Appointment—Oath of office—Bond.

The public administrator shall take and file the oath of office. The amount of the bond required for the public administrator shall be fixed from time to time by resolution of the board of supervisors. Effective January 8, 2007 at noon, the director of health and human services agency is appointed to the office of public administrator.

2.31.020 - Budget duties.

The public administrator shall, on or before June 10th of each year, file with the county auditor-controller an itemized estimate of anticipated revenues that will be received, and proposed expenditures to be made as a result of executing the duties and responsibilities of public administrator. The filings shall be prepared in such a manner as to ensure that the revenues and expenditures of the office of the public administrator are clearly differentiated from the revenues and expenses of any other county budget unit.

2.31.030 - Powers, duties and scope of representation.

A. The public administrator shall not be entitled to retain any of the fees allowed by law for the performance of the duties of the office of public administrator and shall forthwith deposit same in the county treasury.

B. The public administrator shall be represented by the county counsel in all matters relating to the administration of the estates of decedents, except that the public administrator may employ private counsel in those estates in which the public administrator is nominated and would not otherwise have priority under law.

C. Nothing contained herein shall be construed as prohibiting the public administrator from employing private counsel to provide supplementary legal services if the county counsel recommends such employment. In all cases in which a private attorney is so employed, the compensation of the private attorney shall be derived solely from the assets of the estate involved in the legal proceeding, in the form of fees as authorized by the court.

2.31.040 - Compensation and expenses.

No additional compensation shall be paid to the director of health and human services for filling the office and performing the duties of the public administrator. The public administrator shall be allowed actual and necessary traveling expense in the discharge of his or her official duties, which shall be claimed in the manner and at the rate prescribed by the board of supervisors from time to time.
