12.44.360 - Purpose.

This Article is enacted for the purpose of adopting the provisions of the Vehicle Code of the State of California in a manner provided in Section 21107.7 of said Vehicle Code on Rancho San Carlos Road.

12.44.361 - Provisions enacted after receipt of petition.

This Article is enacted after receipt of a petition filed with the County by Santa Lucia Community Services District and the owners of the roadway, which is set forth and more particularly described in Section 12.44.380.

12.44.370 - Application of the Vehicle Code.

Rancho San Carlos Road, as described in Section 12.44.380, is not generally held open for the use of the public for the purpose of vehicular travel, but by reason of its proximity to and connection with highways, the interest of residents residing along said road and the motoring public will best be served by application of the Vehicle Code of the State of California to such road.

12.44.380 - Roads affected.

This Article affects the following road and entrances thereto, and the provisions of the Vehicle Code shall apply to such road:

A. Rancho San Carlos Road, between Carmel Valley Road and the Santa Lucia Preserve Gatehouse, a distance of 1.1 miles.

12.44.390 - Stop intersections.

The following intersections are stop intersections:

A. Intersection of Rancho San Carlos Road and Valley Greens Drive, stops required on all four entrances to the intersection.

B. Intersection of Rancho San Carlos Road and Quail Meadows Place, stop required on Quail Meadows Place at the entrance to Rancho San Carlos Road.

C. Intersection of Rancho San Carlos Road and the Carmel Valley Athletic Club driveway, stop required on the Carmel Valley Athletic Club driveway at the entrance to Rancho San Carlos Road.

12.44.391 - Speed limits.

In accordance with Section 22358 of the Vehicle Code, the following road segments have a designated prima facie speed limit.

A. Rancho San Carlos Road, from its intersection with Carmel Valley Road to Valley Greens Drive: thirty (30) miles per hour.

B. Rancho San Carlos Road, from Valley Greens Drive to the Santa Lucia Preserve Gatehouse: twenty-five (25) miles per hour.

12.44.392 - Signs and markings.

A. The owners of Rancho San Carlos Road, or Santa Lucia Community Services District acting as their agent, shall erect appropriate signs for markings at the entrances to the road described in Section 12.44.380 of such size, shape, and color as will be readily legible during daylight hours for a distance of one hundred (100) feet, to the effect that the road is subject to provisions of the Vehicle Code of the State of California.

B. Pursuant to Vehicle Code Section 21107.7(a), the owners of Rancho San Carlos Road, or Santa Lucia Community Services District acting as their agent, shall erect and maintain traffic regulatory and warning signs and markings as set forth in the submitted "Rancho San Carlos Road Manual on Unified Traffic Control Devices Conformance Report" or subsequent approvals by the County of Monterey pursuant to Section 12.44.393. All regulatory and warning signs not approved by the "Rancho San Carlos Road Manual on Unified Traffic Control Devices Conformance Report" or in conformance with the Manual on Uniform Traffic Control Devices as approved and supplemented by the California State Department of Transportation shall be removed.

12.44.393 - Changes.

A. Requests for changes to the traffic regulatory and warning signs, signals, markings, and devices located on Rancho San Carlos Road and affected by this ordinance, or variances from the design and sitting standards for signs described in Section 12.44.392 shall be made by the owners of Rancho San Carlos Road, or Santa Lucia Community Services District acting as their agent, in writing to the Director of Transportation. The written request shall state the reason for the change and shall be supported by appropriate traffic engineering data as determined necessary by the Director of Transportation.

B. Except as provided in Subsection C below, all changes shall be approved administratively by the Director of Transportation. The decision of the Director of Transportation may be appealed to the County Board of Supervisors.

C. The following changes require an amendment to this Article:

  1. Parking restrictions;

  2. Mid-block crosswalk locations;

  3. Stop and yield sign locations;

  4. Signed turning movement restrictions at intersections;

  5. Speed limit designations; and

  6. The addition or deletion of road segments affected by this ordinance.

12.44.394 - Traffic enforcement.

The Vehicle Code may be enforced on Rancho San Carlos Road in the limit described in Section 12.44.380 by the California Highway Patrol and Monterey County Sheriff's Department pursuant to the current Vehicle Code as it may be amended from time to time.
