12.44.010 - Definitions.

As used in Chapter 12.44:

A. "Driveway" means a roadway giving access from a private road or public highway to a garage or house on ground abutting said private road or public highway.

B. "Private road" means a way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other members of the public.

12.44.020 - Territorial scope.

Chapter 12.44 applies to private roads in the unincorporated territory of the County of Monterey, except as to roads where the County has by ordinance adopted the provisions of the California Vehicle Code in the manner provided in the Vehicle Code.

12.44.030 - Reckless driving prohibited—Penalty.

A. No person shall drive any vehicle on a private road in willful or wanton disregard for the safety of persons or property.

B. Any person who violates this Section, and upon conviction thereof, shall be punished by imprisonment in the County jail for not less than five days nor more than ninety (90) days, or by fine of not less than fifty dollars ($50.00) nor more than two hundred fifty dollars ($250.00), or by both such fine and imprisonment.

12.44.040 - Speed contest prohibited—Penalty.

A. No person shall engage in or aid or abet in any motor vehicle speed contest or exhibition of speed on any private road.

B. Any person who violates this Section shall, upon conviction thereof, be punished by imprisonment in the County jail for not more than ninety (90) days, or by fine of not more than two hundred fifty dollars ($250.00), or by both such fine and imprisonment.

12.44.050 - Throwing substances at vehicles prohibited—Penalty.

A. No person shall throw any substance at any vehicle, or occupant thereof, on a private road.

B. Any person who violates this Section shall, upon conviction thereof, be punished by imprisonment in the County jail for not more than six months, or by fine of not more than five hundred dollars ($500.00), or by both such fine and imprisonment.

12.44.060 - Speed limit.

No person shall drive any vehicle on a private road at a speed greater than is reasonable or prudent, having due regard for weather, visibility, the traffic on and the surface and width of the private road, and in no event shall a person drive a vehicle on a private road at a speed which endangers the safety of persons or property.

12.44.070 - Following too closely prohibited.

The driver of a vehicle on a private road shall not follow another vehicle more closely than is reasonable or prudent, having due regard for the speed of such other vehicle, and the weather, visibility, the traffic on and the condition of the roadway.

12.44.080 - Right-of-way at intersections.

A. The driver of a vehicle approaching an intersection of private roads shall yield the right-of-way to a vehicle, which has entered the intersection from a different private road.

B. When two vehicles enter an intersection from different private roads at the same time, the driver of the vehicle on the left shall yield the right-of-way to the driver of the vehicle on his right.

12.44.090 - Parking restrictions—Exceptions.

A. No person shall stop, park, or leave standing any vehicle, whether attended or unattended, upon the main traveled portion of a private road, or in a position to block any driveway.

B. Every person who stops, parks, or leaves standing an unattended vehicle upon a private road shall position such vehicle off the main traveled portion of the roadway so that the other vehicles may pass freely and without encountering obstructions and so that a clear view of such vehicle shall be available from a distance of two hundred (200) feet from such vehicle in each direction upon such private road.

C. This Section does not apply to the driver of any vehicle which is disabled in such a manner and to such an extent that it is impossible to avoid stopping and temporarily leaving such vehicle on the main traveled portion of a private road.

D. This Section does not apply to a driver who is the owner of the private road.
