Chapter 2.78 — HEALTH CARE SERVICES COMMISSION

2.78.010 - Recognition.¶
There is in the county a health care services commission hereafter in this chapter referred to as the commission.

2.78.020 - Number of members—How selected.¶
The commission consists of eighteen (18) members appointed by the board of supervisors.

2.78.030 - Members' qualifications.¶
Each member of the commission shall be an elector of the county. Eight members of the commission shall be members of the medical or dental professions in good standing with their respective societies.

2.78.040 - Members' terms—Vacancies.¶
Each member of the commission shall hold office for a term not to exceed four years. The term shall expire at the time and in the relative order as to each member of the commission as the term for which he holds office before this chapter takes effect. Before the first day of July in each year, the board of supervisors shall reappoint the member or members to succeed such member or members whose term of service so expires, to serve for a period not to exceed four years. Any vacancy on the commission shall be filled by the board of supervisors for the unexpired term. No member of the commission shall serve more than eight consecutive years.

2.78.050 - Organization—Quorum.¶
The members of the commission shall annually elect one of their members as chairman who shall serve as chairman for one year and who shall preside at all meetings of the commission. If the chairman is absent or unable to act, the members present shall elect one of their members to act as chairman temporarily. The commission may appoint a secretary, who need not be a member of the commission, to serve without compensation. Seven members of the commission shall constitute a quorum necessary to transact the business of the commission at a meeting and no act of the commission shall be valid or binding unless a majority of the members present at such meeting concur therein.

2.78.060 - Removal of members.¶
In cases of misconduct, inability or wilful neglect in the performance of his duties, any member may be removed by the affirmative vote of four members of the board of supervisors. Such member sought to be removed shall be given an opportunity to be heard in his own defense at a public hearing, and shall have the right to appear by counsel and to have process issued to compel the attendance of witnesses, who shall be required to give testimony, if such member of the commission so requests. A full and complete statement of the reasons for such removal, if such member be removed, together with the findings of fact made by the board or supervisors shall be filed by the board of supervisors with the county clerk and made a matter of public record.

2.78.070 - General powers and duties.¶
The commission shall perform the following functions in all matters relating to the health care services agency of this county:
A.
Investigate, study, report and recommend to the director of health care services and to the board of supervisors from time to time, the most efficient and economical methods and manners of providing the services to be rendered to persons entitled thereto;
B.
Investigate, study, report and recommend annually to the director of health care services and to the board of supervisors with respect to fiscal and budget matters;
C.
Assist the board of supervisors to secure a qualified person to fill a vacancy in the position of director of health care services by having representation on any search committee, and by making recommendations to the board of supervisors with regard to candidates certified by the civil service commission.
Commissioners may also serve on search committees for other positions requiring exceptional qualifications;
D.
Investigate, when cause for such action is presented in writing to the commission, the conduct and operation of any person or division in the health care services agency, and make reports and recommendations thereon to the director of health care services, the board of supervisors, and the Grand Jury.
