Editor's note— Ord. No. 2025-8, §§ 2, 3, adopted February 4, 2025, repealed the former Ch. 2.126, §§ 2.126.010—2.126.050, and enacted a new Ch. 2.126 as set out herein. The former Ch. 2.126 pertained to Fairview Municipal Advisory Council and derived from Ord. No. 2017-29, § 1, adopted July 11, 2017.

2.126.010 - Organization.

Pursuant to the provisions of Government Code Section 31010, there is hereby created the following municipal advisory councils or "MACs."

A.

Castro Valley Municipal Advisory Council;

B.

Sunol Citizens Advisory Council;

C.

Fairview Municipal Advisory Council;

D.

Eden Area Municipal Advisory Council; and

E.

East County Municipal Advisory Council.

2.126.020 - MAC areas.

The unincorporated area for which each municipal advisory council is established shall be as follows:

A.

Castro Valley Municipal Advisory Council. The unincorporated area of Alameda County known as "Castro Valley Planning Area" as shown on Map A shall be the "Castro Valley MAC Area."

B.

Sunol Citizens Advisory Council. The unincorporated area of Alameda County known as "Sunol," including the area known as Little Valley, all as shown on Map B shall be the "Sunol CAC Area."

C.

Fairview Municipal Advisory Council. The unincorporated area of Alameda County known as "Fairview" and defined as the area within the boundaries established by the Fairview Area Specific Plan, excluding those areas that are also within the boundaries established by the Castro Valley General Plan, as shown on the map titled "Fairview Municipal Advisory Council Boundaries," dated June, 2017, on file with the Alameda County planning department, and as shown on Map C shall be the "Fairview MAC Area."

D.

Eden Area Municipal Advisory Council. All area within the boundaries established by the March 30, 2010 Eden Area General Plan, excluding the area that is established by the Fairview Municipal Advisory Council, as shown on the map titled "Eden Area Municipal Advisory Council Boundaries," dated July 19, 2019, on file with the Alameda County planning department, and as shown on Map D shall be the "Eden Area MAC Area."

E.

East County Municipal Advisory Council. The unincorporated area of Alameda County as shown on Map E shall be the "East County MAC Area."

Any annexation, withdrawal, or change in city or county boundaries shall be deemed to alter the boundaries of each MAC area correspondingly.

2.126.030 - Duties and purposes.

Each MAC shall advise the board of supervisors on matters concerning the government by the board of supervisors within its respective MAC area of the unincorporated county as described in Section 2.126.020. The advice of each MAC to the board of supervisors shall be on all matters concerning services that are or may be provided to that MAC area by the county or other local governmental agencies, including advice on matters of public safety, welfare, public works, and planning; provided, however, that the Sunol Citizens Advisory Council shall not provide advice on or consider site development reviews for properties located within the area known as the Little Valley. Each MAC may advise the board of supervisors on matters that occur outside that MAC area but would or could have impacts within or otherwise affect that MAC area.

2.126.040 - Membership and terms.

A.

The Castro Valley Municipal Advisory Council and the Eden Area Municipal Advisory Council shall each consist of seven members. The Sunol Citizens Advisory Council, Fairview Municipal Advisory Council, and East County Municipal Advisory Council shall each consist of five members. Members shall be appointed by the board of supervisors following nomination by the supervisor from the following supervisorial district:

Castro Valley Municipal Advisory Council. Nomination shall be by the supervisor or supervisors who represent the Castro Valley MAC Area in proportion to the population of the MAC area in each supervisorial district, with each supervisor who represents the Castro Valley MAC Area having at least one nominee.

Sunol Citizens Advisory Council. The supervisor representing the first district shall nominate all five members.

Fairview Municipal Advisory Council. Nomination shall be by the supervisor or supervisors who represent the Fairview MAC Area in proportion to the population of the MAC area in each supervisorial district, with each supervisor who represents the Fairview MAC Area having at least one nominee.

Eden Area Municipal Advisory Council. Nomination shall be by the supervisor or supervisors who represent the Eden Area MAC Area in proportion to the population of the MAC area in each supervisorial district, with each supervisor who represents the Eden Area MAC Area having at least one nominee.

East County Municipal Advisory Council. The supervisor representing the first district shall nominate all five members.

B.

Each member shall be appointed for a four-year term and shall serve until the member's successor is appointed, except that the board of supervisors shall initially stagger the terms as follows:

For a MAC with seven members: Two of the members' terms shall be for two years, two shall be for three years, and the remaining three members' terms shall be for four years, from the date of board of supervisors' approval of appointment.

For a MAC with five members: One of the members' terms shall be for two years, two shall be for three years, and the remaining two members shall be for four years, from the date of board of supervisors' approval of appointment.

After the expiration of these initial terms, all subsequent terms shall be for four years. A person appointed to fill any vacancy shall serve for the unexpired term of the person they succeed.

No appointee shall serve more than twelve (12) years, or as the board of supervisors may otherwise set out in the board of supervisors "board operating procedures" or any succeeding document. The board of

supervisors may remove any MAC member from office at any time in the manner provided by Section 2.64.040 of this code.

C.

Each MAC member shall be a resident of the respective MAC area. Alternatively, in lieu of residency, for the Castro Valley MAC, Eden Area MAC, Fairview MAC, or East County MAC, MAC members may have owned or operated a business in the MAC area for a period of at least five years prior to their appointment. Any MAC member appointed by virtue of residency in the MAC area shall reside in the MAC area for the entire period of their appointment. Should any such member cease to live in the MAC area during their term, their appointment shall expire immediately upon termination of their residency in the MAC area and the board of supervisors shall appoint a replacement member as indicated in subparagraph A above. Any MAC member appointed by virtue of owning or operating a business in the MAC area shall do so for the entire period of their appointment. Should any member appointed by virtue of their ownership or operation of a business cease to own or operate a business in the MAC area during their term, their appointment shall expire immediately upon the cessation of their participation in a MAC area business and the board of supervisors shall appoint a replacement member as indicated in subparagraph A above.

2.126.050 - Meetings.

Each MAC shall meet at least once each quarter but not more than three times each month at an established time and place and shall consult with the board of supervisors as the board or the MAC may request. Each MAC shall prepare and adopt rules for the conduct of its business and shall be subject to Government Code Sections 54950, et seq. concerning public meetings. Each MAC shall determine a schedule of regular meeting dates, times, and places at the first meeting of the MAC following adoption of the ordinance codified in this chapter and annually thereafter.

2.126.060 - Quorum; action by majority.

A.

For the Castro Valley Municipal Advisory Council and the Eden Area Municipal Advisory Council a quorum for the transaction of business shall consist of four of the MAC's seven members.

B.

For the Sunol Citizens Advisory Council, Fairview Municipal Advisory Council, and East County Municipal Advisory Council a quorum for the transaction of business shall consist of three of the MAC's five members.

C.

All matters shall be decided by the majority vote of the members present.

2.126.070 - Budget and stipend.

Each MAC shall prepare and submit a budget for consideration for adoption by the board of supervisors. MAC members may receive a stipend of fifty dollars ($50.00) for each meeting attended, not to exceed the amount authorized by the board adopted budget for the respective MAC. In addition, the board of supervisors may provide funds for reasonable and necessary MAC expenses.
