10.04.010 - Construction of chapter—Definitions.

The general provisions and definitions contained in this chapter shall govern the construction of this chapter, unless the context otherwise requires.

"Bus stop" means that space adjacent to a curb reserved exclusively for the loading and unloading of passengers of a bus and marked and designated as provided in this chapter.

"County property" means real property, including any buildings thereon, in the unincorporated and incorporated areas of the county that is owned, leased, or controlled by the county and includes, without limitation, public buildings and facilities and their surrounding grounds and improvements, walkways,

footpaths, stairs, planters, access ramps, railings, monuments, fountains, plazas, driveways, parking lots, or other paved areas. For the purposes of this chapter, "county property" shall not include county roads, streets, highways, sidewalks, lanes or alleys, as defined by the California Vehicle Code.

"Crosswalk" means any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface.

"Disabled person and veterans parking zone" means that space adjacent to a curb reserved exclusively for the use of disabled persons and veterans and marked and designated as provided in this chapter.

"Loading zone" means that space adjacent to a curb reserved exclusively for the loading or unloading of passengers or freight and marked and designated as provided in this chapter.

"One-way highway" means a highway or part thereof on which vehicular traffic, including bicycles, and driven animals shall move only in that direction indicated by signing erected and maintained at every intersection and where movement in the opposite direction is prohibited.

"Park" or "parking" means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.

"Parking zone" means that portion of a street or highway whereon an operator may be authorized to park any vehicle, during such time and in the manner authorized by this chapter. Each provision in this title regulating parking shall be subject to later provisions regulating parking which may include areas already regulated.

"Skateboard" means any vehicle, device, or contrivance with any number of wheels, with a riding surface of any design, upon which a person may place one or both feet, and which is designed to be, or can be, propelled by human power, and which is not defined as a bicycle by the California Vehicle Code. The term "skateboard" also includes motorized skateboards.

"Taxi stand" means that space adjacent to a curb reserved exclusively for the use of operators of taxicabs in the business of transporting passengers for fares while engaged in loading and unloading passengers of, or while waiting for employment by passengers for, such taxicab, marked and designated as provided in this chapter.

10.04.020 - Duties of the director of public works.

The director of public works of the county shall place, erect, and maintain all signs, signals, and painted markings required by this chapter.

10.04.030 - Exemption for emergency vehicles.

The driver of an authorized emergency vehicle, as defined in Sec. 165 of the Vehicle Code of the state, shall be exempt from the provisions of this chapter whenever driving in response to an emergency call or in the immediate pursuit of an actual or suspected violation of the law or when responding to but not returning from a fire alarm. The exemptions authorized by this section shall apply only when the driver of the vehicle sounds a siren as may be reasonably necessary and the vehicle displays a lighted red lamp visible from the front as a warning to others.

10.04.040 - Physicians et al.—Exemptions regarding parking.

Vehicles of physicians while in attendance upon patients are exempt from those provisions of this chapter relating to parking. Other vehicles are also exempt from those provisions of this chapter relating to parking when it is necessary to park in the protection of human health or life or public safety.

10.04.050 - Public vehicles—Exemptions.

This chapter shall not apply to the duly authorized representatives of any public agency or to public employees and publicly owned motor vehicles and other equipment, while actually engaged in work upon the surface of a highway, or work of installation, removal, repairing or maintaining traffic signs, signals or other traffic control devices, but shall apply to such persons and vehicles when traveling to or from such work.

10.04.060 - Vehicle Code of the State of California.

The Vehicle Code of the State of California shall be referred to as Vehicle Code.

10.04.070 - Chapter applies to persons using bicycles or animals.

Every person riding a bicycle or riding or driving an animal upon a highway shall be subject to all of the duties made applicable to the driver of a vehicle by this chapter, except those provisions which by their very nature can have no application.

10.04.080 - Hill parking regulated.

It shall be unlawful for any person driving, or in control of, or in charge of a motor vehicle to permit it to stand unattended, within any business or residence district, on any portion of a public highway, in the unincorporated area of the county, having a grade exceeding three percent without effectively setting the brakes thereon and blocking a front wheel of said vehicle against the curb, by turning the front wheels in such a direction as to cause the forward portion of one of the front wheels to come in contact with the curb when the vehicle is facing downhill, or the rear portion of one of the front wheels to come in contact with the curb when the vehicle is facing uphill; if there is no curb, other suitable means shall be used to block the movement of the wheels of said vehicle.

10.04.090 - Use of streets for the storage of vehicles prohibited.

It is unlawful for any person who owns or has possession, custody or control of any vehicle to park such vehicle upon any county highway for more than a period of seventy-two (72) consecutive hours and any officer mentioned in Section 22651 of the Vehicle Code may remove such a vehicle from a highway.

10.04.100 - Prima facie presumption.

In any prosecution charging a violation of this chapter, proof by the people of the state of California that the particular vehicles described in the complaint was parked in violation of the provisions of this chapter, together with proof that the defendant named in the complaint was at the time of such parking the registered owner of such vehicle, shall constitute in evidence a prima facie presumption that the registered owner of such vehicle was the person who parked or placed such vehicle at the point where, and for the time during which, such violation occurred, upon compliance with the conditions specified in Sec. 41102 of the Vehicle Code.

10.04.110 - Parking prohibited—Driveways—Exceptions.

No person shall stop, park, or leave standing any vehicle whether attended or unattended in front of a public or private driveway, except that a bus engaged as a common carrier, school bus, or a taxicab may stop to load or unload passengers.

10.04.120 - Driving of vehicles and bicycles in pedestrian underpasses—Prohibition.

It is unlawful for any person to drive a self-propelled vehicle, bicycle, or horse in a pedestrian underpass maintained by the county.

10.04.130 - Driving of vehicles and bicycles in pedestrian underpasses—Signs.

Appropriate signs shall be placed and maintained by the director of public works at the entrance to each pedestrian underpass setting forth the aforementioned prohibition.

10.04.140 - Tire chains or snow tires—Use required—Signs.

It is unlawful for any person to operate any motor vehicle, trailer or semi-trailer upon any portion of a county highway without tire chains or snow tread tires used as an alternate in conformance with the provisions of Sections 27459 and 27460 of the Vehicle Code when such portion of the county highway is signed for the requirement of such chains or snow tread tires. The director of public works shall have the authority to place signs setting forth said requirements.

10.04.150 - Skateboards.

A.

Prudent Operation. No person shall ride or propel a skateboard upon a roadway at a speed greater than is, or in a manner other than is, reasonable or prudent having due regard for weather, visibility, the traffic on, and the grade, surface and width of, the roadway, and in no event at a speed or in a manner which endangers his safety or the safety of other persons or property.

B.

Heavily Traveled Roads. No person shall ride or propel a skateboard on any roadway which has been divided into two or more clearly marked lanes for traffic in each direction.

C.

Attachment to Vehicles. No person riding or propelling a skateboard on a roadway shall attach the same or himself to any vehicle, animal or bicycle.

D.

Intersections. No person shall ride or propel a skateboard within one hundred (100) feet of his approach to or departure from any intersection of highways or within any such intersections.

E.

Interference with Vehicles. No person shall ride or propel a skateboard on or across any roadway in such a manner as to interfere with the movement of vehicles thereon.

F.

Business District. No person shall ride or propel a skateboard in the streets, sidewalks, or public parking areas of any business district in the county.

G.

Hours of Darkness. No person shall ride or propel a skateboard on a roadway during the hours of darkness.

H.

Packages. No person riding or propelling a skateboard on a roadway shall carry any package, bundle or article in his hands.

I.

Bicycle Lanes. No person shall ride or propel a skateboard in the bicycle lane described in Section 10.24.080

J.

Safe Operation. Any person riding or propelling a skateboard on a roadway shall do so in a standing

position, with at least one foot resting on the skateboard at all times, and in no event shall the rider kneel, sit or lay on a skateboard, or allow his hands to contact the skateboard while riding.

K.

Skateboarding Prohibited. No person shall ride or propel a skateboard on county property at or on the following locations:

1.

County of Alameda Administration Building at 1221 Oak Street, Oakland, California 94612;

2.

Rene C. Davidson Court House at 1225 Fallon Street, Oakland, California 94612; or

3.

Any other county property, provided that the property is clearly and conspicuously posted with signs stating that skateboarding is prohibited.

10.04.160 - Parking prohibited.

A.

It shall be unlawful for any person driving, or in control of, or in charge of a motor vehicle to permit it to stop, park, or stand either attended or unattended, on any portion of a public highway in the unincorporated area of the county, in violation of the restrictions established pursuant to the Alameda County Public Works Traffic Code.

B.

A copy of the Alameda County Public Works Traffic Code shall be kept on file with and maintained by the Alameda County public works agency, traffic department, for use and examination by the public.
