Chapter 10.08 — STATE HIGHWAY TRAFFIC REGULATIONS

10.08.010 - Construction of chapter—Definitions.

The definitions and general provisions contained in this chapter shall govern the construction of this chapter, unless the context requires otherwise.

"Bus stop" means that space adjacent to a curb reserved exclusively for the loading and unloading of passengers of a bus engaged as a common carrier in local transportation and marked and designated as provided by this chapter.

"Cross walk" means any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface.

"Loading zone" means that space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or freight and marked and designated as provided by this chapter.

"Parking zone" means that space adjacent to a curb whereon an operator is not authorized to park or leave standing any vehicle whether the vehicle is attended or unattended, except during such times and in the manner provided by this chapter.

"Taxi stand" means that space adjacent to a curb reserved exclusively for the use of operators of taxicabs in the business of transporting passengers for fares while engaged in loading and unloading passengers of, or while waiting for employment by passengers for, such taxicab, and marked and designated as provided by this chapter.

10.08.020 - Duties of the director of public works.

The director of public works shall erect, place, and maintain all signs, signals and markings required by this chapter.

10.08.030 - Chapter applies to persons using bicycles or animals.

Every person riding a bicycle or riding or driving an animal upon a highway shall be subject to all of the duties made applicable to the driver of a vehicle by this chapter, except those provisions which by their very nature can have no application.

10.08.040 - Exemption—Drivers of authorized emergency vehicles.

The driver of an authorized emergency vehicle as defined in the Vehicle Code of the state shall be exempt from the provisions of this chapter whenever the vehicle is being driven in response to an emergency call or when used in the immediate pursuit of an actual or suspected violator of the law, or when responding to but not upon returning from a fire alarm.

The exemptions of this section shall apply only when the driver of the vehicle sounds a siren as may be reasonably necessary and the vehicle displays a lighted red lamp visible from the front as a warning to others.

10.08.050 - Exemption—Physicians et al.—Parking.

Vehicles of physicians while in attendance upon patients are exempt from those provisions of this chapter relating to parking. Other vehicles are also exempt from those provisions of this chapter relating to parking when it is necessary to park the same in the protection of human health or life or public safety.

The provisions of this chapter shall not apply to the duly authorized representatives of any public agency or to public employees and publicly owned teams, motor vehicles and other equipment, while actually engaged in work upon the surface of a highway, or work of installation, removal, repairing or maintaining traffic signs, signals or other traffic control devices, but shall apply to such persons and vehicles when traveling to or from such work.

10.08.060 - Effective period.

This chapter and each of the sections thereof shall remain in full force and effect until six months after receipt by the board of supervisors of written notice from the department of public works of the state of withdrawal of such department's approval of such chapter or any section thereof, or until repealed by the board of supervisors, whichever is the earlier.

10.08.070 - Prima facie evidence.

In any prosecution charging a violation of this chapter, proof by the people of the State of California that the particular vehicle described in the complaint was parked in violation of the provisions of this chapter, together with proof that the defendant named in the complaint was at the time of such parking the registered owner of such vehicle, shall, subject to the provisions of Sections 41102 and 41103 of the Vehicle Code, constitute prima facie evidence that the registered owner of such vehicle was the person

who parked or placed such vehicle at the point where, and for the time during which, such violation occurred.

10.08.080 - Hill parking regulated.

It shall be unlawful for any person driving, or in control of, or in charge of a motor vehicle to permit it to stand unattended, within any business or residence district, on any portion of state highway routes, except freeways having a grade exceeding three percent, without effectively setting the brakes thereon and blocking a front wheel of said vehicles against the curb, by turning the front wheels in such a direction as to cause the forward portion of one of the front wheels to come in contact with the curb when the vehicle is facing downhill, or the rear portion of one of the front wheels to come in contact with the curb when the vehicle is facing uphill; if there is no curb, or if the structure of the curb or the vehicle's wheel is such that turning of the wheel will not effectively block the movement of the wheels of said vehicle, then other suitable means shall be used to block the movement of the wheels of said vehicle.

10.08.090 - Use of streets for the storage of vehicles prohibited.

It is unlawful for any person who owns or has possession, custody or control of any vehicle to park such vehicle upon any state highway route, except freeways, in the unincorporated area of the county for a period of more than seventy-two (72) consecutive hours and any officer mentioned in Section 22651 of the Vehicle Code may remove such a vehicle from the highway.

10.08.100 - State Route 238.

On those segments of State Route (SR) 238 (south of I-580 within the unincorporated Alameda County area), not presently nor hereafter designated Foothill Boulevard, the permissible gross weight of vehicles shall be nine thousand (9,000) pounds or less. The alternate route for vehicles greater than nine thousand (9,000) pounds is I-880 or SR-185 (Mission Boulevard). Excepted from this restriction are police and fire department vehicles, passenger buses, recreation vehicles, and utility vehicles needed to service sections of SR-238.
