10.24.010 - Construction of chapter—Definitions.

The general provisions and definitions contained in this chapter shall govern the construction of this chapter, unless the context otherwise requires.

"Bicycle" means a device upon which any person may ride, propelled by human power through a belt, chain or gears, and having either two or three wheels in a tandem or tricycle arrangement.

"Bicycle lane" means that portion of a highway or of any other right-of-way, situated in the unincorporated area, which is set apart by the use of lines or other physical delineations and is designated in this chapter.

"Pedestrian" means any person who is afoot or who is using a means of conveyance propelled by human power other than a bicycle.

10.24.020 - Registration required.

A.

No person who is a resident of the unincorporated territory of the county shall operate or use a bicycle propelled wholly or in part by muscular power upon any streets or public highways within said unincorporated territory without first registering said bicycle with the sheriff or with the local fire chief. The local fire chief shall be such fire chief as is designated by the sheriff.

B.

The sheriff and the local fire chief are hereby authorized and directed to register, upon application, bicycles. Such registration shall be effective until revoked or until the bicycle is sold or transferred as hereinafter set forth. Said registration shall entitle the applicant to operate such bicycle upon all the streets, alleys, and public highways, exclusive of sidewalls thereof, in the unincorporated territory of the county.

C.

Bicycle Identification. The sheriff shall provide and assign suitable registration numbers. The sheriff shall also keep a record of the date of registration, to whom issued, and the number thereof.

The sheriff or local fire chief is authorized as a means of identification to stamp said numbers on the frames of bicycles.

10.24.030 - Dealers—Reports of purchase and sales.

All persons engaged in the business of buying secondhand bicycles are hereby required to make a daily report to the sheriff's office, giving the name and address of the person from whom each bicycle is purchased, the description of said bicycle, and the frame number thereof, if any.

All persons engaged in the business of selling new or secondhand bicycles are hereby required to make a daily report to the sheriff's office, giving a list of all sales made by such dealers, which list shall include the name and address of each person to whom sold, the kind of bicycle sold, together with a description and frame number thereof, if any.

It shall be a misdemeanor to violate any provisions of this section.

10.24.040 - Transfer report required.

It shall be the duty of every person who sells or transfers ownership of any bicycle, to report such sale or transfer to the sheriff or fire chief, where bicycle is registered, the name and address of the person to whom said bicycle was sold or transferred, and such report shall be made within ten days of the date of sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer of registration therefor within ten days of said sale or transfer.

10.24.050 - Removal of destruction of identification.

It shall be unlawful for any person to remove, destroy, mutilate or alter the number of any bicycle frame, during the time in which the registration of such bicycle is operative.

10.24.060 - Duty of bicycle operator.

Every person operating a bicycle upon a bicycle lane has all the rights and is subject to all the duties applicable to the driver of a vehicle upon a roadway, as set forth in Division 10 and Division 11 of the Vehicle Code of the state, except those provisions which by their very nature can have no application.

10.24.070 - Bicycle lanes.

A.

Restriction of Use. A bicycle lane, marked in accordance with the provisions of this chapter, is restricted to the use of pedestrians and the riders of bicycles.

B.

Right-of-Way. A person riding or operating a bicycle emerging from an alley, driveway, bicycle lane, or building, upon approaching a sidewalk or the sidewalk area, shall yield the right-of-way to any pedestrian approaching on said sidewalk or sidewalk area, and upon entering a bicycle lane shall yield the right-of-way to all bicycles approaching upon said lane, and upon entering the roadway shall yield the right-of-way to all vehicles approaching on said roadway.

C.

Direction of Travel. No person shall ride or operate a bicycle within a bicycle lane in any direction except that permitted of vehicular traffic traveling on the same side of the roadway; provided the bicycles may proceed either way along a lane where arrows appear on the surface of the lane designating two-way bicycle traffic.

D.

Right-of-Way at Intersection. Upon approaching an intersection, any person riding or operating a bicycle shall yield the right-of-way to all vehicles within or approaching such intersection except that all vehicles which must stop before entering an intersection because of a stop sign and all vehicles making a turn at an intersection shall not proceed into said intersection nor make such a turn without first yielding the right-ofway to all bicycles within or approaching said intersection and shall proceed only when it is safe to do so.

E.

Riding in Bicycle Lanes. Once having entered a bicycle lane, no person riding or operating a bicycle shall leave such lane except at intersections. Provided, however, that such person may leave a bicycle lane upon dismounting from a bicycle, walking the same and being subject then to all laws applicable to pedestrians. Provided, further, that such person may leave the bicycle lane between intersections in order to make a U- turn, where such a turn is permissible for vehicular traffic or to turn into driveways on the right- or left-hand side of the bicycle lane. Upon leaving a bicycle lane, the rider or operator of such bicycle shall yield the right-of-way to all vehicles and shall not leave the bicycle lane until it is safe to do so.

F.

Vehicles in Bicycle Lanes. No person shall drive a vehicle on or across a bicycle lane except to make a right turn at an intersecting street or to enter a driveway or to pick up or discharge passengers or to park such vehicle or leave a parking space when provided adjacent to the bicycle lane or to obtain emergency parking. Emergency parking shall be allowed in bicycle lanes for disabled vehicles and emergency vehicles only. Emergency parking shall be effected only at the farthest point away from the center of the roadway that permits the safety of the vehicle. No person shall drive a vehicle upon or across a bicycle lane as permitted by this section except after giving the right-of-way to all bicycles in the lane.

G.

Riding on Sidewalks. No person shall ride or operate a bicycle upon a sidewalk except in residential areas or when the sidewalk is designated as a bicycle lane. Whenever any person is riding or operating a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian.

H.

Position of a Bicyclist in Bicycle Lane. While proceeding in a bicycle lane, a bicyclist must ride in the farthest most right-hand portion of the lane when possible. In a bicycle lane designated for two-way travel, bicyclist must ride at the right-hand side, such that in passing, opposite moving bicycles will be to the respective bicycle rider's left.

10.24.080 - Bicycle lanes designated—Marking.

The portions of highways or of any other right-of-way designated in this chapter are bicycle lanes. The director of public works shall install and maintain appropriate signs and markings indicating the location and extent of such bicycle lanes and the regulation thereof.

A. East Avenue (Murray Township).

On the northerly and southerly sides, approximately nine feet wide, from the easterly Livermore City Limit (134 feet east of Auburn Street) to the westerly Livermore City Limit (842 feet west of South Vasco Road); and

On the northerly side, approximately nine feet wide, from the easterly curbline of South Vasco Road, easterly a distance of 3620 feet; and

On the southerly side, approximately nine feet wide, from the easterly curbline of South Vasco Road, easterly a distance of 3180 feet.

B. Stanley Boulevard and East Stanley Boulevard.

Southeasterly and southerly side, approximately eight to ten feet wide, from the Pleasanton City Limit, northeasterly and easterly to the westerly curbline of Murdell Lane.

C. Bernal Avenue.

On the easterly and westerly sides, approximately six feet wide, from Tawny Drive to the east leg of Vineyard Avenue.

D. Grant Avenue.

Northwesterly and southeasterly sides, approximately six feet wide, from the southwesterly curbline of Channel Street to the northeasterly curbline of Bockman Road.

E. Cull Canyon Road.

Generally easterly and westerly sides, approximately five feet wide, from a point 160 feet northwesterly from the northwesterly curbline of Crow Canyon Road to a point 510 feet northeasterly from the northerly curbline of Heyer Avenue.

F. Verona Road.

On the generally center of Verona Road, approximately 10 feet wide, from a point 120 feet westerly from the westerly curbline of Pleasanton Sunol Road, westerly to the easterly curbline of Foothill Road.

G. Vineyard Avenue.

On the northerly and southerly sides, approximately eight feet wide, from the Pleasanton City Limit west of Mavis Drive to Bernal Avenue.
