Chapter 9.44 — LASER POINTERS

9.44.010 - Definition.

"Laser pointer" means any handheld device, capable of emitting a laser beam, which is not designed for use as an attachment to a firearm or for use in a medical procedure.

9.44.020 - Directing laser device at eyes of another or into a moving vehicle.

No person shall intentionally focus or direct the beam from a laser device directly or indirectly into the eye or eyes of another person or into a moving vehicle. Violation of this section is punishable as an infraction pursuant to Government Code section 25132 or as a misdemeanor.

9.44.030 - Possession of laser devices by minor prohibited.

No minor shall possess or use a laser device except under the direct supervision and control of the minor's parent, legal guardian, or other adult authorized by the parent or legal guardian to exercise such supervision. Violation of this section is punishable as an infraction pursuant to Government Code section 25132(b).

9.44.040 - First violations.

It shall be within the discretion of the court to impose a punishment of a first violations of either Section 9.44.020 or Section 9.44.030 of this chapter by community service or education in lieu of a monetary fine

pursuant to Government Code section 25132.
