Chapter 9.32 — TRESPASS ON BUSINESS PROPERTY

9.32.010 - Definitions.¶
"Business property" means real property or structures located within the unincorporated area and classified for commercial uses.
"Peace officer" means the sheriff and his deputies who have been authorized in writing by the owner, lessee, or other person in charge of the property, to provide officer's assistance in dealing with a trespass. A single authorization may be made to cover a limited period of time not to exceed six months.

9.32.020 - Trespass upon business property prohibited.¶
A.
No person shall remain upon any business property after being notified by the owner, lessee, or other person in charge thereof, or by a peace officer, to leave the property.
B.
No person shall enter upon business property after having been notified by the owner, lessee, or other person in charge thereof, or by a peace officer, to keep off or keep away from the property.
C.
Exceptions. This chapter shall not apply in any of the following instances:
1.
Where its application results in or is coupled with an act prohibited by the Unruh Civil Rights Act;
2.
Where its application results in or is coupled with an act prohibited by Section 365 of the Penal Code relating to duties of innkeepers and common carriers;
3.
Where its application results in an interference with or inhibition of peaceful labor picketing;
4.
Where its application results in an interference with or inhibition of the exercise of constitutionally protected freedom of speech such as peaceful expressions of political or religious opinions, not involving offensive personal conduct.

9.32.030 - Enforcement.¶
Violation of the provisions of this chapter constitutes an infraction.
