Chapter 2.38 — HUMAN RESOURCE SERVICES AND CIVIL SERVICE COMMISSION

2.38.010 - Recognition.

There is in the county a human resource services department, hereafter in this chapter referred to as the department.

2.38.020 - Civil service commission.

There is in the department a civil service commission which consists of five commissioners appointed by the board of supervisors.

2.38.030 - Members' qualifications.

Commissioners shall be appointed only from electors of the county who have been residents of the county for five years next preceding their appointments, and whose names are upon the assessment roll at the time of appointment. No commissioner shall hold any other county salaried office.

2.38.040 - Members' terms.

Each commissioner shall be appointed for a term of years as set forth in this section and until his successor is appointed and qualified. The terms of members appointed to increase the commission from three to five, pursuant to Section 33 of the Charter of the county of Alameda as approved by the Legislature on July 8, 1968, shall be as follows: one term shall extend until the first Monday after the first day of January, 1970; the other shall extend until the first Monday after the first day of January, 1972. The terms of the

Commissioners incumbent on June 4, 1968, are continued to the expiration of their current terms. All appointments made subsequent to the adoption of this section shall be for a term of five years.

2.38.050 - Removal of members.

A commissioner may be removed during this term of office by a four-fifths vote of all the members of the board of supervisors, but only upon stating in writing the reasons for such removal, and allowing him an opportunity to be publicly heard in his own defense.

2.38.060 - President.

The commission shall elect one of its members president.

2.38.070 - Members' compensation and expenses.

Each commissioner shall receive compensation in the amount set forth in Section 3-4.1, of the Alameda County Salary Ordinance, for each meeting that the Commissioner attends. In addition thereto, commissioners shall be reimbursed the actual amounts of their reasonable and necessary expenses incurred in attending meetings in accordance with the provisions of Chapter 3.36, Travel, Mileage and Vehicle Expenses, of this code.

2.38.080 - Executive officer.

The executive officer of the department is the director of human resource services appointed by the board of supervisors. The director of human resource services shall be in immediate charge of the human resource services department, including but not limited to labor relations services, personnel services, training and education center, disabilities program management, and the employee benefits center. The director of human resource services, if so appointed by the civil service commission, shall be the chief examiner, and serve as secretary to the civil service commission.

2.38.090 - General powers and duties.

The commission may adopt rules for the enforcement of the civil service provisions of applicable state laws, the Charter and ordinances not inconsistent therewith.

2.38.100 - Powers and duties—Classification and allocation.

The commission shall provide for the classification of all positions in the classified civil service and from time to time for the reclassification of any or all such positions and for the allocation and reallocation of individual positions to classes in such manner as to permit and encourage the filling of higher classes by promotion. In the performance of such duty, the commission shall be guided by the following principles: The allocation of a position to a class shall derive from and be determined by the ascertainment of the duties and responsibilities of the position and shall be based on the principle that all positions shall be included in the same class if:

A.

Sufficiently similar in respect to duties and responsibilities that the same descriptive title may be used;

B.

Substantially the same requirements as to education, experience, knowledge and ability are demanded of incumbents;

C.

Substantially the same tests of fitness may be used in choosing qualified appointees;

D.

The same schedule of compensation can be made to apply with equity.

Each such action of the commission shall be submitted to the board of supervisors and shall become effective upon approval by said board.

2.38.110 - Examinations.

The commission shall also provide for the preparation and holding of competitive examinations in order to test the relative fitness of all applicants for appointment to or promotion in the classified civil service; provided, however, that noncompetitive qualifying examinations may be given to incumbents with tenure in positions which are reclassified or reallocated and that the name of each incumbent who qualifies in such qualifying examination shall be placed on an eligible list and the said incumbent shall be appointed subject to probation to the reclassified or reallocated position. At least ten days' notice shall be given of each competitive examination.

2.38.120 - Probationary period.

The commission shall also provide a period of probation for each class in the classified civil service before appointment or promotion is completed, during which period a probationer may be discharged or reduced. Each such action of the commission shall be submitted to the board of supervisors and shall become effective upon approval by said board.

2.38.130 - Certification of payroll.

The commission shall also examine the payrolls of all employees in the classified civil service, and the county auditor shall not pay or approve any payment of salaries to such persons unless there appears on the payroll a certification by the commission that the persons named thereon have been appointed to their respective positions in accordance with the provisions of this code and the Charter of the county.

2.38.140 - Annual salary recommendation.

The commission shall also recommend to the board of supervisors at least sixty (60) days prior to the end of each fiscal year a rate of pay for each class in the classified civil service based upon a comparison of salaries being paid for like service and working conditions in other comparable places of public and private employment in order that all salaries shall be uniform for like service in each class of the classified civil service.

2.38.150 - Investigations—Subpoena power—Oaths.

The commission, for the purpose of carrying into effect the civil service provisions of the Charter and ordinances not inconsistent therewith, may investigate the conduct and operation of any department or

board, and subpoena and require the attendance of witnesses and the production of books and papers, and administer oaths.

2.38.160 - Failure to comply—Sanctions.

Any person failing to obey the subpoena of the commission or refusing to testify or produce books or papers required of him shall be deemed to be in contempt, and the commission may take such proceedings in the punishment thereof as may be taken by boards of supervisors as provided by the laws of the state.
