2.130.010 - Purpose and intent.

The ordinance codified in this chapter is adopted pursuant to the provisions of the Children and Families First Act, Proposition 10, effective January 1, 1999 now codified as Section 7 to Article XIII A and Section 13, Article XIII B of the California Constitution, Section 5, Division 108 of the Health and Safety Code, commencing with Section 130100 and Article 3 of Chapter 2 of Part 13 of Division 2 of the Revenue and Taxation Code commencing with Section 30131. This chapter is intended to implement the provisions of the Act as it pertains to the establishment of community-based local programs with funds made available through the Children and Families First Trust Funds.

2.130.020 - Recognition.

There is hereby established in the county of Alameda a commission to be known as "First 5 Alameda County" and hereinafter in this chapter referred to as the "First 5 Alameda County" or "commission."

2.130.025 - Legal status of the commission.

The Alameda County Children and Families First Commission shall be established as a legal public entity separate from the county, and shall be subject to conditions, as specified pursuant to Section 5, Division 108, Section 130140.1 of the California Health and Safety Code.

2.130.030 - Establishment of Children and Families First Trust Fund.

There is hereby established within the county treasurer a local First 5 Alameda County Trust Fund, to be set up by the Alameda County auditor and the Alameda County treasurer to receive deposits of children and families trust funds. Funds deposited shall be expended for the purposes authorized by the Children and Families First Act of 1998, in accordance with the county strategic plan approved by the First 5 Alameda County.

2.130.040 - Number of members—How selected—Qualifications—Compensation and expenses.

A.

The commission consists of nine members appointed by the board of supervisors. The members of the commission shall be persons from among the following categories: one or more members from the board of supervisors, one or more members from county department personnel responsible either for children's services, public health services, including tobacco control services, behavioral health services or social services(referred to collectively as "county department personnel services"). The remaining members shall be from among but not limited to recipients of project services included in the strategic plan; educators specializing in early childhood education; representatives of local child care resource or referral agencies; representatives of a local organization for prevention of families at risk; representatives of communitybased organizations that have a goal of promoting early childhood development; representatives of local school districts; or representatives of local medical associations. Members from the board of supervisors and members from the county department personnel services may designate a staff person in writing to the commission's chairperson to serve as an alternate member to represent them, and vote and participate in their absence at meetings.

B.

Members shall serve without compensation and shall be reimbursed the actual amounts of their responsible and necessary expenses incurred in attending meetings and in performing the duties of their offices, in accordance with the provisions of Chapter 3.36 of this code, Travel, Mileage and Vehicle Expenses.

2.130.050 - Members' terms—Vacancies.

Commission members shall serve at the pleasure of the Board of Supervisors. The term of office shall be for four years and until the appointment of the member's successor.

A.

If no successor has been appointed at the expiration of the term, the commissioner shall serve until the appointment and qualification of the member's successor;

B.

Notwithstanding Section 2.130.040(A) above regarding alternate members, if any commissioner has three consecutive unexcused absences from regularly scheduled meetings, the board of supervisors shall appoint a new commissioner to serve the unexpired term;

C.

Of the initial appointees, four shall be appointed for a two-year term and five shall be appointed for a fouryear term;

D.

Any vacancies shall be filled by the board of supervisors for the unexpired term;

E.

No commissioner shall serve for more than twelve (12) consecutive years unless the board of supervisors waives this provision upon a majority vote of its members.

2.130.060 - Chairperson.

The commission shall annually select one of its members to serve as chairperson, who shall preside at meetings of the commission, and one of its members as vice-chairperson, who shall preside in the absence of the chairperson.

2.130.070 - Meetings.

The commission shall meet up to six times per year.

2.130.080 - Quorum.

The quorum shall consist of a simple majority of the number of members appointed.

2.130.090 - Duties and powers of the commission.

The duty of the commission is to implement the provisions of the California Children and Families Act of 1998. To this end, the commission shall at all times take such action as is required by the California Children and Families Act of 1998 as presently written or subsequently amended.

2.130.100 - Operating requirements.

The Board of Supervisors shall direct appropriate county departments to cooperate with the commission and to provide staff necessary to assist the commission in the performance of its duties.
