Chapter 7.76 — VEHICLE REPAIR ON STREETS

The Board of Supervisors finds and declares:

The repair of vehicles on highways other than emergency repairs constitutes an unsightly and hazardous condition.

The public health, safety, and welfare would be benefitted by prohibiting vehicle repair on highways other than emergency repairs.

As used in this chapter the following definitions apply:

(a)

"Emergency Repairs" means either any repair which is accomplished within one hour or any repair as may be necessary in case of an accident or mechanical failure to enable the removal of the vehicle from the highway. In the case of any accident or mechanical failure, the emergency repair shall be completed within twenty-four hours of the accident or mechanical failure.

(b)

"Highway" means a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Highway includes street.

(c)

"Repair" means repair, grease, change oil or other fluids, construct, modify, or alter. Repair includes causing those actions to be done. Repair does not include washing or waxing.

"Vehicle" means a device by which a person or property may be propelled, moved, or drawn upon a highway, except a device moved by human power or used exclusively upon statutory rails or tracks.

No person shall repair any vehicle on a highway except for emergency repairs.

A violation of section 7.76.030 may be punished as an infraction.
