Chapter 5.76 — SOLID WASTE FACILITY FEES

5.76.010 - Purpose and authority.¶
The purpose of this chapter is to establish permit and inspection fees for solid waste facilities in order to reimburse the County of San Mateo for its expenses in enforcing State statutes, rules and regulations regarding such facilities. Sections 66796.30(i) and 66796.20 of the California Government Code, respectively, grant authority to the County to impose the permit and inspection fees hereinbelow.

5.76.020 - Scope and Application.¶
The fees prescribed by this chapter shall apply to all solid waste facilities within the geographic areas in which the San Mateo County Office of Environmental Health is responsible for enforcing State statutes, rules or regulations relating to solid waste facilities.

5.76.030 - Definition.¶
The terms used in this chapter shall have the same meaning defined for them in Sections 66714 et seq., of the California Government Code.

5.76.040 - Imposition of permit fees.¶
Any person, who after August 15, 1977, proposes to commence operating or modify the operation of, or to transfer the ownership of a solid waste facility shall be assessed a fee according to fees identified in
Section 5.64.060.¶

5.76.050 - Exemption from permit fees.¶
The County Health Officer may exempt a solid waste facility from payment of the permit fee if he finds after a public hearing that:
(a)
The exemption is not against the public interest, and
(b)
The quantity of solid waste is insignificant, and
(c)
The nature of the solid waste proposes no significant threat to the public health or safety or to the environment.

5.76.060 - Imposition of inspection fees.¶
Any person who after August 15, 1977, proposes to commence operating or modify the operation of, or to transfer the ownership of a solid waste facility shall be assessed a fee according to fees identified in
Section 5.64.060.¶

5.76.070 - Inspection fees.¶
Inspection fees shall be assessed to operators of solid waste facilities in equal quarterly installments. Said fees shall be computed by dividing the adjusted weight of solid waste handled at the facility during the preceding fiscal year by the total adjusted weight handled at all solid waste facilities in the County during such year. Such quotient shall then be multiplied by the total projected cost of the County Solid Waste Management Enforcement Program during the current fiscal year to obtain the fee for the facility. Each quarterly installment of said fee shall be payable within thirty (30) days of the receipt of the invoice of said installment.

5.76.080 - Definition.¶
The term "adjusted weight" as used in fee calculations is determined by multiplying actual weight of waste handled by any solid waste facility by the following factors:

Collection Points 0.25

5.76.090 - Exemption from inspection fees.¶
The Health Officer may exempt a solid waste facility from payment of that portion of the inspection fees which represents the cost of inspection for garbage, refuse, and demolition debris not including wastewater or water treatment plant sludge, as measured by weight, that is generated within the County of San Mateo.

5.76.100 - Penalty for late payment.¶
If any fee required by this chapter has not been paid within 45 days from the due date, there shall be imposed a penalty equal to twenty-five percent (25%) of the said fee. Failure to pay any fee required by this chapter within 90 days from the due date shall result in annual interest charge of 18% on any outstanding balance due. Where the County Health Officer determines that such delinquency has been caused by excusable neglect on the part of the person billed or by mistake on the part of the Division, the penalties may be waived.
