Chapter 5.52 — MOBILE FOOD PREPARATION UNITS

5.52.010 - Definition.¶
As used in this chapter, mobile food preparation units means the same as that term is defined at California Health and Safety Code 27526, that is, any vehicle or portable food service unit upon which food is prepared for service, sale or distribution at retail and shall not include vehicles from which prepackaged food or approved unpackaged foods is sold or offered for sale as prescribed by article 11 of Chapter 4 of the California Uniform Retail Food Facilities Law.

5.52.020 - License.¶
No person shall operate, maintain or carry on the business of a mobile food preparation unit on County roads without first receiving License therefor from the License Board of the County of San Mateo to engage in such business.

5.52.030 - License fee and term.¶
Every person conducting the business of a mobile food preparation unit on County roads shall pay a fee of $200 for the License, the term of which shall be one year.

5.52.040 - Condition of operation.¶
It shall be unlawful for a mobile food preparation unit to remain in any one location on any County road for the purpose of sale or display of food or food products for more than thirty (30) minutes during any eight (8) hour period, or to return to the same location on a County road within any eight (8) hour period. In addition to being a violation of this ordinance any mobile food preparation unit which fails to move at least one thousand (1000) feet from its prior location on a County road within any eight (8) hour period shall be deemed to be in a fixed position and subject to all state health laws and regulations including those from which mobile food preparation units are exempt.

5.52.050 - Hours of operation.¶
Mobile food preparation units shall operate on County roads only between the hours of 7 A.M. and 6 P.M., Monday through Friday and between 10 A.M. and 6 P.M. on Saturday and Sunday.
The first, second and third violations of this ordinance within one year shall be an infraction punishable as stated in Government Code Section 25132(b). Any violation within one year after the third violation shall be a misdemeanor.
