Chapter 5.72 — FORTUNE TELLING

5.72.010 - License required.¶
(a)
It shall be unlawful for any person, whether as principal, servant, agent or employee, to engage in the business, profession, occupation or calling of clairvoyance, palmistry, astrology, spiritism or fortune telling of any kind or nature, by whatsoever name called, without first procuring the License provided for by this chapter.
(b)
It shall be unlawful for any person, whether as principal, servant, agent or employee, to advertise or solicit by newspaper, advertisement, public display, circular, sign, letter or card or otherwise in behalf of any business, profession, occupation or calling mentioned in subsection (a) of this section, unless said person shall have first procured the License provided for by this chapter.

5.72.020 - Application for License.¶
Application for the License required by this chapter shall be filed with the Clerk of the Board of Supervisors, verified by the oath of the Applicant and shall contain the following information:
(a)
The name, age and sex of the Applicant.
(b)
The residence address of the Applicant.
(c)
The business and residence address of the Applicant during the period of five (5) years next preceding the date of the Application.
(d)
The nature of the business, profession, occupation or calling in which the Applicant has been engaged during the said period of five (5) years.
(e)
A statement as to whether or not the Applicant has ever been charged with a public offense with the place, date, nature and disposition of said charge.
(f)
The address at which the Applicant intends to engage in the business, profession, occupation, or calling for which the Application is made, the nature of the business, profession, occupation or calling for which the Application is made.
Said Application shall have attached thereto a photograph of the Applicant and a full set of the fingerprints of Applicant together with a certificate of the Sheriff, showing that the said finger prints were made and taken by said officer. In the event that the License applied for is granted, the photograph and fingerprints required herein shall be delivered to the Sheriff.

5.72.030 - Hearing on Application.¶
The Application shall be set for hearing before the Board of Supervisors at the next following regular meeting of the Board and notice thereof given by the Clerk of said Board to the Applicant. At the hearing the Applicant, and any other person interested in said Application, may present any facts material to the advisability of granting the License. The Board of Supervisors shall grant the License applied for unless it shall appear that the character of the Applicant for morality, honesty or integrity is not good or unless it shall appear that the business, profession, occupation or calling for which Application is made is immoral, dangerous or dishonest.

5.72.040 - Issuance of License, conditions of.¶
If said License is granted, the License herein required shall be procured from the Tax Collector. Said License shall bear date of the day it is issued and shall be valid for a period of one (1) year from said date, provided that any and all such Licenses are issued, accepted and held subject to the pleasure of the Board of Supervisors and the said License, together with any License granted by the Board of Supervisors, may be revoked by said Board at any time for such cause as to said Board upon investigation seems sufficient. Said License shall specify by name the person to whom it is issued, the place at which the business, profession, occupation or calling is to be carried on, the date of its issuance, the term for which it is issued, a statement of the quarterly payments made or due thereon, a designation of the business, profession, occupation or calling for which it is issued. Said License shall not be in any manner transferable or assignable nor shall any such License authorize the Applicant to engage in the said business, profession, occupation or calling at any other place than the place designated in said License.

5.72.050 - License fee.¶
The Tax Collector is authorized and required to collect all Licenses and sums of money provided for by this chapter. For every License issued under this chapter, the Applicant shall pay a License fee to the County of San Mateo in the sum of Two Thousand Four Hundred Dollars ($2,400) per annum, payable quarterly in advance. No License held by any person, firm or corporation shall be deemed or considered in compliance
with the provisions of this chapter unless all quarterly payments due on said License shall have been paid to date.
