2.24.010 - Office of Public Guardian created.

Pursuant to Government Code Sections 27430 et seq., the office of the Monterey County Public Guardian is created.

2.24.020 - Consolidation of offices, appointment and supervision of the Public Administrator/Public Guardian.

A. Pursuant to Government Code Section 24011, the County offices of Public Administrator and Public Guardian shall be consolidated into one office to be known as the Public Administrator/Public Guardian effective February 1, 2006 at 12:01 a.m. The same person shall hold the offices of Public Administrator and Public Guardian.

B. The Director of Health, with the concurrence of the Board, shall be the appointing authority for the Public Administrator/Public Guardian.

C. The Public Administrator/Public Guardian shall be an employee in the County Health Department who shall report directly to the Director of Health.

D. Except as otherwise specifically provided by law, all authority and responsibility as appointing authority for the Public Administrator/Public Guardian is delegated by the Board of Supervisors to the Director of Health, including the following:

  1. The responsibility to implement through line management and day-to-day supervision, the policy and direction set by the Board of Supervisors and the mission of the Public Administrator/Public Guardian's office under the direction of such department head;

  2. The coordination of the Public Administrator/Public Guardian's work between all affected County departments, offices, and agencies, and the setting of priorities;

  3. The preparation of annual performance evaluations for the Public Administrator/Public Guardian; and

  4. The responsibility for proposing and/or taking corrective action, when and to the extent deemed necessary by the Director of Health; except that termination of the individual appointed as Public Administrator/Public Guardian shall require the concurrence of the Board of Supervisors.

2.24.030 - Authority and duties of Public Guardian.

The Public Guardian shall have all of the authority now or hereafter conferred on public guardians by law, and shall discharge all the duties now or hereafter imposed on public guardians by law. The Board of Supervisors may by resolution fix the amount of such bond.

2.24.040 - Bond.

The Public Guardian shall file an official bond as may be now or hereafter be required by law.
