2.08.010 - Sheriff-Coroner-Public Administrator.

A. Commencing January 1, 1982, the offices of Sheriff, Coroner and Public Administrator are consolidated in one office to be known as Sheriff-Coroner-Public Administrator of the County of Monterey, the duties of which shall be performed by one person elected to such office in the manner prescribed by law.

B. Effective on February 1, 2006 at 12:01 a.m., the consolidated Office of the Sheriff-Coroner-Public Administrator is separated into the consolidated Office of the Sheriff-Coroner and the Office of the Public Administrator.

2.08.011 - Compensation.

The Sheriff-Coroner-Public Administrator shall be compensated at the rate of four thousand four hundred sixty-six dollars ($4,466.00) per month. The Board of Supervisors may at any time after January 1, 1982, change such rate of compensation in accordance with Section 25300 of the Government Code.

2.08.012 - Severability.

If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the portions of this ordinance not held to be unconstitutional. The Board of Supervisors hereby declares that it would have passed this ordinance and any section, subsection, clause or phrase thereof irrespective of the fact that one or more sections, subsections, clauses or phrases thereof be declared unconstitutional.

2.08.013 - Coroner services.

A. The Coroner shall perform those services authorized by the Government Code Section 27471, and the fee for taking custody of a body shall be one hundred sixty-five dollars ($165.00). The Coroner shall also perform those services authorized by Government Code Section 27472, and shall collect fees of one hundred sixty-five dollars ($165.00) for removing a body and thirty dollars ($30.00) per day for storage. These fees are based on actual cost of services pursuant to Government Code Section 54985.

B. The Coroner is authorized to scatter the remains of individuals, with respect to whom it has control over disposition, at the County-owned cemetery which is located at the corner of Natividad Road and Laurel Street, in compliance with all provisions of existing law, including, but not limited to, Health and Safety Code Sections 7116 and 7054.7.

2.08.020 - Assessor, County Clerk and Recorder.

A. The duties of the County offices of Assessor, County Clerk, and Recorder, respectively, are consolidated in one office to be known as Assessor-County Clerk-Recorder of the County of Monterey, the duties of which shall be performed by one person elected to such office in the manner prescribed by law.

B. The salary of the Assessor-County Clerk-Recorder is fixed by the County Salary Ordinance.

2.08.030 - Treasurer and Tax Collector.

A. Pursuant to the authority vested in the Board of Supervisors by virtue of Section 24300 of the Government Code of the State of California, the duties of the County offices of Treasurer and Tax Collector, respectively, are consolidated in one office to be known as Treasurer-Tax Collector of the County of Monterey, the duties of which shall be performed by one person elected to such office in the manner prescribed by law.

B. The salary of the Treasurer-Tax Collector of the County of Monterey is fixed by the annual salary ordinance.

2.08.031 - Qualifications.

No person shall be eligible for election or appointment to the office of Monterey County Treasurer-Tax Collector unless that person meets at least one of the following criteria:

A. The person has served in a senior financial management position in a county, city, or other public agency dealing with similar financial responsibilities for a continuous period of not less than three years, including, but not limited to, Treasurer, Tax Collector, Auditor, Auditor-Controller, or the Chief Deputy or an assistant in those offices.

B. The person possesses a valid baccalaureate, masters, or doctoral degree from an accredited college or university in any of the following major fields of study: business administration, public administration, economics, finance, accounting, or a related field, with a minimum of sixteen (16) college semester units, or their equivalent, in accounting, auditing, or finance.

C. The person possesses a valid certificate issued by the California State Board of Accounting pursuant to Chapter 1 (commencing with Section 5000) of Division 3 of the Business and Professions Code, showing that person to be, and a permit authorizing that person to practice as, a certified public accountant.

D. The person possesses a valid charter issued by the Institute of Chartered Financial Analysts showing the person to be designated a Chartered Financial Analyst, with a minimum of sixteen (16) college semester units, or their equivalent, in accounting, auditing, or finance.

E. The person possesses a valid certificate issued by the Treasuring Management Association showing the person to be designated a Certified Cash Manager, with a minimum of sixteen (16) college semester units, or their equivalent, in accounting, auditing, or finance.

F. This Section shall only apply to any person duly elected or appointed to the office of Monterey County Treasurer-Tax Collector on or after January 1, 1998.

2.08.032 - Continuing education requirements.

A. On and after January 1, 1998, any person elected or appointed to the Office of Treasurer-Tax Collector shall complete a valid continuing course of study as prescribed in this Section, and shall during the person's four-year term of office on or before June 30th of the fourth year, render to the State Controller a certification indicating that the person has successfully completed a continuing education program consisting of, at a minimum, forty-eight (48) hours, or an equivalent amount of continuing education units within the discipline of treasury management or public finance or both, offered by a recognized State or national association, institute, or accredited college or university, that provides that requisite educational programs prescribed in this Section.

B. The willful or negligent failure of the elected County Treasurer-Tax Collector to comply with the requirements of this Section shall be deemed a violation of this Section.
