92513.00 - Zoning Map No. 13—Melon Area.

The map entitled "Melon Area," Zoning Map No. 13 is adopted to designate a specific land use zone for each parcel of land within the area of the map. Zone Map No. 13 shall become effective July 1, 1998.

92513.01 - Amendment to Zoning Map No. 13 "Melon Area."

The zone classification of those certain parcels of real property situated in the county of Imperial, state of California, and more particularly described as:

The zone classification of those certain parcel(s) of real property being legally identified as:

Parcel 1: All of Tract 93 and 94 in Township 14 South, Range 14 East, San Bernardino Base and Meridian, in the county of Imperial, state of California, according to official plat thereof.

Parcel 2: Those portions of Tract 99, 190, and 191, all in Township 14 South, Range 14 East, San Bernardino Base and Meridian, in the county of Imperial, state of California, according to official plat thereof.

Parcel 3: Tracts 100 and 101, in Township 14 South, Range 14 East, San Bernardino Meridian, in the county of Imperial, state of California, according to the Official Plat Thereof, excepting therefrom, that portion of Tract 101 granted to the state of California for freeway purposes in deed recorded October 22, 1946 in Book 666, Page 421 of Official Records.

Parcel 4: Those portions of Tract 99 and 190 in Township 14 South, Range 14 East, San Bernardino Meridian, in the county of Imperial, state of California according to the official plat thereof, lying west of the west right-of-way line of the Southern Pacific Railroad right-of-way, as said right-of-way was located November 30, 1981. Assessor's parcel numbers 040-190-001, 040-190-002, 040-190-004 and 040-200-001.

The zone change shall be as follows:

Parcel 1: All of Tract 93 and 94 in Township 14 South, Range 14 East, San Bernardino Base and Meridian, in the county of Imperial, state of California, according to official plat thereof.

Parcel 2: Those portions of Tract 99, 190, and 191, all in Township 14 South, Range 14 East, San Bernardino Base and Meridian, in the county of Imperial, state of California, according to official plat thereof.

Parcel 3: Tracts 100 and 101, in Township 14 South, Range 14 East, San Bernardino Meridian, in the county of Imperial, state of California, according to the official plat thereof, excepting therefrom, that portion of Tract 101 granted to the state of California for freeway purposes in deed recorded October 22, 1946, in Book 666, Page 421 of Official Records.

Parcel 4: Those portions of Tract 99 and 190 in Township 14 South, Range 14 East, San Bernardino Meridian, in the county of Imperial, state of California, according to the official plat thereof: lying west of the west right-of-way line of the Southern Pacific Railroad right-of-way, as said right-of-way was located November 30, 1981. Assessor's parcel numbers 040-190-001, 040-190-002, 040-190-004 and 040-200-001.

Is hereby changed from: "A-2 and A-3" (general agriculture and heavy agriculture to 101 Ranch Specific Plan Area" (designated SPA).

92513.02 - Amendment to Zoning Map No. 13 "Melon."

The zone classification of those certain parcel(s) of real property being legally identified as a portion of in the unincorporated area of the county of Imperial, state of California, according to the official plat thereof, assessor parcel numbers 140-130-010 and 140-130-012, and more particularly described as follows:

Tracts 108, 109, 117 and 118, Township 14 South, Ranch 14 East, S.B.M., in an unincorporated area of the county of Imperial, state of California, according to official plat thereof.

Excepting there that portion of said Tracts 108 and 109, conveyed to the state of California, by deed recorded May 23, 1947, in Book 678, Page 150 of Official Records.

Also, excepting therefrom that portion of said Tract 109, lying north of Highway 99, as said highway was located on September 3, 1948.

Also, excepting therefrom said Tract 117, that portion thereof, described as follows: Commencing at the Northeast corner of said Tract 117; thence continuing South 0 07, West, along the East line of said tract, a distance of 390.35 feet to the point of beginning; thence continuing South 0 07, West, along said east line, a distance of 1181.3 feet to a point; thence North 89 49, West, a distance of 839.04 feet to a point in the easterly right-of-way line of the Southern Pacific Railroad; thence North 15 38, East, along said easterly right-of-way line a distance of 1,225 feet to a point; thence South 89 49, East, a distance of 513.20 feet to the point of beginning. Also excepting therefrom that portion of Tract 117, described as follows: Beginning at the northeast corner of said Tract 117; thence South 0 07 05, West, along the east line of said Tract, 390.35 feet to the northeast corner of land described in Deed to Imperial Compress Company, a co-partnership, recorded August 31, 1961 in Book 1088, Page 217 of Official Records; thence west along the North Boundary of said Imperial Compress Company's Land to the Northwest Corner thereof; being a point on the east right-of-way line of the Southern Pacific Railroad; thence north 15, 38. 05. East, along said east right-of-way line, 405.07 feet to the North line of said Tract 117; thence south 89.50.55, East, along said north line, 403.31 feet to the point of beginning.

Also excepting therefrom said Tract 117 and 118 that portion lying within the Southern Pacific Railroad right-of-way as acquired by act of congress dated March 3, 1875.

Also excepting therefrom one-half of all oil, gas, hydrocarbon and hydrocarbon substances and one-half of all minerals and gases, including, but not limited to, hot water, steam, minerals in solution, the natural heat of the earth, the energy present in, resulting from the natural heat of the earth, lying below a depth of five hundred feet (500) from the surface as reserved by BC System Inc., a Delaware corporation in deed recorded March 1, 1985, as Document No. 10, in Book 1537, Page 518 of Official Records.

Also excepting therefrom one-half of all oil, gas, hydrocarbon and hydrocarbon substances and one-half of all minerals and gases, including, but not limited to, hot water, steam, minerals in solution, the natural heat of the earth, the energy present in, resulting from the natural heat of the earth, lying below a depth of five hundred feet (500) from the surface as reserved by John R. Benson Farms, Inc., in the deed recorded October 10, 1989, in Book 1634, Page 507 of Official Records.

Said legal description is pursuant to Certificate of Compliance Lot Line Adjustment #110, described as Parcel 'A' recorded April 22, 1997 as Document No. 97010254, in Book 1888, Page 1460 of Official Records.

Title to said estate or interest as of August 23, 2005 is vested in:

James D. Jameson and Daphne H. Jameson, Trustees of the Jameson Family Trust dated November 19, 1987, as amended, as to an undivided thirty-four percent (34%) interest; David Dominquez, Trustee of the Jameson Irrevocable Trust II F/B/O Justin Dockeray Jameson dated July 19, 2005, as to undivided eight percent (8%) interest; David Dominquez, Trustee of the Jameson Irrevocable Trust II F/B/O Alexandra Dockeray Jameson dated July 19, 2005, as to an undivided eight percent (8%) interest; John R. Benson, Trustee for the Benson Children Trust of December 27, 1976, as to an undivided twenty-five percent (25%) interest; and

John R. Benson and Carolyn F. Benson, husband and wife, as community property, as to an undivided twenty-five percent (25%) interest.

THE ZONE CHANGE SHALL BE AS FOLLOWS:

A-2U" (general agriculture urban) to "Rancho Los Lagos Specific Plan" zones as designated in the Rancho Los Lagos Specific Plan (SPA).

AM-1 (agriculturally related light industrial) to "Rancho Los Lagos Specific Plan" zones as designated in the Rancho Los Lagos Specific Plan (SPA).
