2.40.010 - Office created.

Pursuant to the authority vested in the board of supervisors of Imperial County by Sections 27640 to 27645, inclusive, of the Government Code of the state of California, there is established pursuant thereto the office of county counsel of the county of Imperial, and the holder thereof shall discharge all duties which may now or hereafter be vested in such office by the laws of the state of California, and the ordinances and resolutions of the board of supervisors.

2.40.020 - Attorney to public administrator.

The county counsel shall act as attorney for the public administrator in all estates in which he or she is executor, administrator with will annexed, or administrator, and in all conservatorship wherein the public administrator serves as conservator of the person, estate, or both person and estate. In such matters, the county counsel shall collect the attorney's fees allowed by law and pay them into the county treasury.

2.40.030 - Attorney to public social services director and county probation officer for…

The county counsel shall act as attorney for the director of the department of social services and the county probation officer in all matters involving juvenile dependency (Welfare and Institutions Code Section 300 cases), guardianships for dependent children, petitions for freedom from parental custody and control, and similar actions. In such matters, county counsel shall claim reimbursement of costs as authorized pursuant to the cost allocation program approved by the state of California and the county auditor-controller.

2.40.040 - Attorney to Imperial County retirement board.

The county counsel shall act as attorney for the Imperial County retirement board, and the Imperial County retirement administrator in all matters pertaining to the administration of the Imperial County employees' retirement system. Such duties include representing the system and advising the board in contested quasi-judicial proceedings before the board of retirement disability retirement matters.

2.40.050 - Attorney to Imperial County board of equalization.

The county counsel shall act as attorney for the Imperial County board of equalization in all matters under the jurisdiction of that board. In such matters, the county counsel shall collect fees as provided for in this chapter.

2.40.060 - Property tax appeals—Written findings of fact—Collection of fees/deposits.

Written findings of fact and conclusions will be made available-at the request of the applicant in property tax appeals matters, provided the applicant pays the actual costs of time and materials incurred by county counsel in preparing such findings. The costs shall include eighty dollars ($80.00) per attorney hour for time expended by the county counsel's office in preparing the findings and other actual costs. A deposit equal to the estimated total cost of preparing the findings, or a minimum deposit of three hundred twenty dollars ($320.00) per parcel, shall be paid by the applicant to the clerk of the board of supervisors, either prior to the hearing or prior to the conclusion of the hearing and deposited into the appropriate revenue account in the county counsel's office. If the costs incurred are less than the deposit amount, the unused portion shall be returned to the applicant. If the costs exceed the deposit amount collected, the applicant will be required to pay the same before the findings will be released.
