2.16.010 - Short title.

This chapter shall be known and may be cited as the "Office of County Clerk/Recorder and Registrar of Voters Ordinance." (Prior code § 23990)

2.16.020 - Purpose.

This office of county clerk/recorder of the county of Imperial is established as the result of the consolidation of the office of county clerk and the office of county recorder pursuant to Government Code Section 24304. This consolidation [is] to be for the public interest, and shall benefit the public. (Prior code § 23991)

2.16.030 - Duties in general.

A. The county clerk/recorder shall perform the duties established for county clerk by Title 3, Division 2, Part 3, Chapter 3 of the Government Code, and the duties established for recorder by Title 3, Division 2, Part 3, Chapter 6 of the Government Code. The county clerk/recorder shall carry out the duties prescribed for his or her office by state laws and regulations, county ordinances and resolutions, and orders and directions of the board of supervisors.

B. As a further responsibility, the board of supervisors authorizes the county clerk/recorder to accept maps prepared as exhibits and/or attachments to the certificate of completion issued by the executive officer of the Local Agency Formation Commission for Imperial County. The map shall be prepared in the following manner:

  1. It shall be legibly drawn, printed, or reproduced by a process guaranteeing a permanent record in black on tracing cloth or polyester base film. Certificates, affidavits, and acknowledgements may be legibly stamped or printed upon the map with opaque ink. If ink is used on polyester base film, the ink surface shall be coated with a suitable substance to assure permanent legibility.

  2. The size of each sheet shall be eighteen (18) inches by twenty-six (26) inches. A marginal line shall be drawn completely around each sheet, leaving an entirely blank margin of one inch. The scale of the map shall be large enough to show all details clearly and enough sheets shall be used to accomplish this end. The particular number of the sheet and the total number of sheets comprising the map shall be stated on each of the sheets, and its relation to each adjoining sheet shall be clearly shown.

  3. The map shall be placed by the county recorder in a book entitled "Miscellaneous Map Book."

C. In addition, the board of supervisors authorizes the county clerk/recorder to accept and to record instruments entitled "Notice of Condemnation" and "Notice of Dismissal of Condemnation Action." The notices shall include the following information: owner(s) name and address; address and legal description of the condemned property; and if appropriate, a description of the violations subject to condemnation. All notices shall be signed by the authorized officer for the enforcement agency.

D. In addition, the board of supervisors authorizes the county clerk/recorder to accept and to record instruments entitled "Encroachment Permit" and "Release of Encroachment Permit." The permit shall include the following information: name and address of the underlying fee owner(s) of record; address and legal description of the real property affected by the permit; and a description of the authority granted by the permit. The permit shall be signed by the authorized officer for the enforcement agency and the underlying fee owner(s) of record and all signatures shall be acknowledged by a notary public. The release shall include the following information: name and address of the underlying fee owner(s) of record and address and legal description of the real property affected by the release. 2.16.040 - Duty to act as registrar of voters is eliminated.

Effective January 3, 2011, at 12:00 noon, the county clerk/recorder shall no longer have the duties of the registrar of voters. The registrar of voters shall be a separate and appointed position. (Prior code § 23993)

2.16.050 - Compensation.

The county clerk/recorder shall be elected by the public and shall receive as compensation for his or her services a monthly salary as established by the board of supervisors. (Prior code § 23994)

2.16.060 - Authorization for collection of fees by the county clerk/recorder and registrar of voters.

In addition to statutory fees required to be collected by the county clerk/recorder and registrar of voters, each office is authorized by the board of supervisors to make reasonable charges for its services and collect such fees. (Prior code § 23995)

2.16.080 - Instrument filing fee.

Pursuant to Section 27361.4 of the Government Code, there is imposed an additional fee of one dollar ($1.00) for filing every instrument, paper, or notice for record, in order to defray the cost of converting the county recorder's document storage system to micrographics. Upon completion of the conversion and payment of the costs therefor, such additional fee shall no longer be imposed. (Prior code § 23997)

2.16.090 - Preliminary twenty-day notice filing fee.

A. Pursuant to Government Code Section 27361.9, the board of supervisors is authorized to provide for the establishment of a fee to defray the cost of the county recorder for maintaining a system to facilitate compliance with the filing and notification requirements for preliminary twenty-day notices (private works), as required by Civil Code Section 3097. The board of supervisors herein authorizes such fees for the exclusive purpose of defraying such cost of the county clerk/recorder.

B. Each person requesting the filing of a preliminary twenty-day notice (private works) shall pay a fee of seventy dollars ($70.00) for each notice filed. (Prior code § 23998)
