Article 3 — Powers and Duties

6503 - Applicability.

The purpose of this article is to provide minimum standards of enforcement to safeguard life, property, and public welfare by regulating and controlling the various activities on the airports owned and operated by the County of Ventura. These rules shall at no time be construed to conflict with FAA Regulations.

6503-1 - Authority of the Director of Airports.

The Director of Airports or his designated representative shall be subject to the direction, authority and control of the County Executive Officer and the Ventura County Board of Supervisors. The Director shall have the right, power, and authority to enforce the following:

(a)

General Authority: The airports' Director or his designated representative is vested with all rights, powers, and authority of the County to issue orders and enforce orders, laws, and regulations affecting the airports, inclusive of the Uniform Fire Code, Vehicle Code, Penal Code, Public Utilities Code, and Building and Safety Code applicable to the safe operation of the airports.

(b)

Specific Authority: The airports administrative powers and duties shall include, but not be limited to the following:

(1)

Designating aircraft operating areas, parking and tie-down areas;

(2)

Assigning parking and tie-down areas;

(3)

Moving or ordering the movement of any aircraft to any other location he/she designates when it is determined that the change is in the best interest of safety or is necessary because of space limitations or traffic conditions, or in order to reduce the risks due to fire, collision or aircraft movement;

(4)

Ordering unauthorized aircraft to leave the airport;

(5)

Promulgating regulations for the operation and administration of public facilities at the airport.

(c)

Delay of Aircraft Operations: The Director of Airports or his designated representative may delay or restrict any aircraft operation subject to any limitations imposed by State or Federal law in accordance with the following standard:

(1)

Discretion may only be exercised where there is reason to believe that a person or aircraft will violate or has violated the proprietary rights of the County, that a violation of this code is imminent, or that its exercise is necessary for the protection of the public health, safety, or welfare.

(2)

The Director of Airports or his designated representative, by appropriate notice, may restrict or suspend all flights of flying when required by military needs, emergency, or other special circumstances.

6503-2 - Delegation of authority.

Whenever a power is granted to, or a duty is imposed upon the Director, that power may be performed by a deputy or an assistant to the Director, or by a person authorized by the Board of Supervisors unless provided otherwise herein.

6503-3 - Enforcement.

Pursuant to the authority vested in the Board of Supervisors by the State of California, the Director of Airports or his designated representatives shall have the authority to enforce the provisions consisting of Chapter 5 of Division 6 of the Ventura County Airports Ordinance Code. Enforcement will be accomplished in such a manner as to promote not only airport safety but also goodwill with the users of the airports.

6503-4 - Penalty.

Violations of any provision of this chapter, except as hereinafter noted, will constitute infractions unless specifically designated misdemeanors. Every conviction of an infraction is punishable by: (1) a fine not exceeding one hundred dollars ($100.00) for a first violation; (2) a fine not exceeding two hundred dollars ($200.00) for a second violation of the same ordinance within one year; and (3) a fine not exceeding five hundred dollars ($500.00) for each additional violation of the same ordinance within one year.

Every conviction of a misdemeanor may result in a fine and/or imprisonment in the County jail for a period of not more than six months.

Any violation of this chapter or any other County ordinance, federal, state, or local statute or regulation governing the standing or parking of a vehicle, which violation occurs on or after July 1, 1993, is subject to a civil penalty as provided for under the California Vehicle Code and/or any civil administrative procedure adopted by the County of Ventura.
