Article 2 — License Applications— Procedures and Appeals

2131 - Application approval.

Any written application for a license or the renewal of a license which by any provision of this Chapter must contain information in addition to the general information required by Section 2113-2 shall be approved by the Sheriff, or such other person as may be so authorized by this Chapter, prior to issuance of the license.

2131-1 - Verification.

Each application required by Section 2131 shall contain the following declaration:

"I declare under penalty of perjury that the foregoing is true and correct."

The application shall be signed and dated by the applicant or an officer thereof at the end of the application, designating the place where it was signed.

2132 - Procedure.

When, by any provision of this Chapter, an applicant must obtain Sheriff's approval prior to issuance of a license, such applicant shall obtain an application form from the Sheriff and submit the completed application to the Sheriff. If fingerprints are required, the applicant shall pay, in the form of a money order payable to the State of California, Department of Justice, the required fee established by the State for processing fingerprints. Said money order shall be submitted to the Sheriff with the completed application. Upon receipt, the Sheriff shall process the application and notify the applicant of approval or disapproval within 30 days. The Sheriff shall keep the original of such application on file in his office.

2132-1 - Issuance.

Whenever the Sheriff approves an application for a license, the Sheriff shall notify the Tax Collector by forwarding to the Tax Collector a copy of the application marked, "Approved." The license fee shall be paid to the Tax Collector prior to the issuance of the license.

2132-2 - Renewal.

The applicant for renewal shall pay the annual renewal fee, and unless the Tax Collector has been notified by the Sheriff prior to the renewal date to not renew the license, the Tax Collector shall issue a new license marked "Renewed."

2133 - Appeals.

Any person whose application for a license or permit is disapproved or whose license or permit is suspended or revoked after a hearing may appeal to the Board of Supervisors within thirty (30) days after the date of such denial, suspension or revocation by filing with the Clerk of the Board of Supervisors a request that the Board review such denial, suspension or revocation. The appeal shall be in the form of a written notice filed with the Clerk of the Board of Supervisors and signed by the appellant. The notice shall have attached a copy of the written application, suspension or revocation, and shall state clearly and concisely the reasons upon which the appellant relies for his appeal. The Clerk of the Board shall set the matter for hearing within fifteen (15) days after the notice is filed, and shall give notice of such setting to the appellant and to the Sheriff or such other person as may have disapproved, revoked or suspended the license pursuant to this Chapter.

2133-1 - Refund.

Except as otherwise provided in this Chapter, whenever a license is revoked pursuant to this Chapter and the licensee does not appeal the revocation, any part of the license fee in excess of ten dollars ($10.00) shall be refunded to the licensee within thirty (30) days after such revocation. Except as otherwise provided in this Chapter, whenever the licensee appeals the revocation and the Board upholds such revocation, any part of the license fee in excess of ten dollars ($10.00) shall be refunded to the licensee within thirty (30) days of such decision by the Board.

2133-2 - Notice.

Whenever a license is revoked by the Sheriff, the Sheriff shall notify the Tax Collector promptly of such revocation. If it is the determination of the Sheriff that a license should not be renewed, the Sheriff shall notify the Tax Collector prior to the renewal date.
