Article 1 — Temporary Shows

2211 - License required.
No person as a principal shall carry on, manage or conduct any tent show, carnival, musical or theatrical exhibition or entertainment, traveling show or traveling entertainment, circus, menagerie, animal show, turkey shoot, or temporary gathering of any nature whatsoever which is open to the public, when the same is held, carried on, managed or conducted in the open air, in any tent, or in a temporary place of business, without first obtaining a license therefor.

2212 - License application.
Application for a license to conduct or manage any tent show, carnival, musical or theatrical exhibition or entertainment, traveling show or traveling entertainment, circus, menagerie, animal show, turkey shoot, or temporary gathering of any nature whatsoever which is open to the public, shall be made to the Sheriff a minimum of sixty (60) days prior to the event by any of the principals sponsoring the event on an application form approved by the Sheriff. Such application shall contain, but is not limited to, the following information:

(a)
Name, address and phone number of the principals sponsoring the event(s).
(b)
The date upon which the event(s) is to be held.
(c)
The address (location) of the place where the event(s) is to be held.
(d)
The time(s) at which the event(s) is to be held.
(e)
The approximate attendance expected and the minimum number of principals who will be in attendance at all times during the event(s).
(f)
The names, addresses and phone numbers of the principals who will be in attendance at said event(s).
(g)
The admission charge or donation, if any, required as an incident to the attendance of said event(s).
(h)
Whether or not alcoholic beverages will be sold to, or possession permitted by, those attending the event(s). "Alcohol Beverage" shall mean and include alcohol, spirits, liquor, wine, beer and every liquid or solid containing alcohol, spirits, wine or beer and which contains one-half of one percent of alcohol by volume and which is fit by beverage purposes either alone or when diluted, mixed or combined with other substances.

2213 - License requirements.
(a)
A permit from the County Fire Warden to conduct the business which is the subject of the application.
(b)
One conspicuously identifiable security person, as approved by the Sheriff, will be employed by the sponsoring principal and be in attendance at all times during the event(s) per each two hundred (200) attendees, or fraction thereof in attendance. Additional such persons will be required if the Sheriff determines it is necessary for proper law enforcement.
(c)
The place or premises where the event(s) will be held will be reasonably adequate for the purposes and conforms with existing health, safety and fire ordinance of the County of Ventura.

2214 - Fees.
The fee for obtaining licenses to conduct the businesses described in Section 2211 are as follows:

(a)
For circus, menagerie, or animal shows where the price of admission for adults does not exceed fifty cents, the fee is $50.00 per day.
(b)
For circus, menagerie, or animal shows where the price of admission for adults is more than fifty cents, the fee is $100.00 per day.
(c)
For dog or pony shows, the fee is $25.00 per day.
(d)
For other tent shows and carnivals, the fee is $45.00 per day. (Am. Ord. 2449—4/27/71)
(e)
For musical or theatrical exhibitions or entertainments, the fee is $30.00 per day. (Add. Ord. 2449—4/27/71)
(f)
For turkey shoots, the fee is $35.00 per day. (Add. Ord. 2449—4/27/71)
(g)
For other traveling shows or traveling entertainments, or other temporary gatherings, the fee is $15.00 per day. (Add. Ord. 2449— 4/27/71)
(h)
For gatherings in excess of 1,000 persons to a maximum 5,000 persons per day, the fee shall be $100.00 per day for events not exceeding three (3) consecutive days.
For gatherings in excess of 5,000 persons per day, the fee shall be predicated upon actual staff expense incurred for preparation.
(i)
In addition to the above, when the event necessitates additional County services and personnel to protect the general health, safety and welfare, extraordinary fees will be charged, as determined by the Sheriff.

2215 - Exclusion from fees.
While a license is required, no fee shall be required to the issuance of a license to conduct any activity described in Section 2211 of this Article, to any organization which is conducted wholly for the benefit of charitable purposes, and from which a profit is not directly derived by a private individual whether as profits, salary, wages or rental for the use of the property of such person. Nor shall any fee be required for the issuance of a license for the purpose of conducting any entertainment, concert, exhibition, or lecture on scientific, historical, literary, religious, or moral subjects whenever the receipts of such entertainment, concert, exhibition, or lecture are to be appropriated and used by any church or school or for any religious or benevolent purposes within the County, nor shall any fee be required for the issuance of a license for conducting any entertainment, concert or otherwise are to be appropriated for the purpose or object for which such association or organization is formed and from which profit is not derived either directly or individually by any person. In all such matters, the Sheriff shall determine eligibility for exclusion.

2216 - Approval.
Upon the filing of an application for a license to conduct an event enumerated in Section 2211, the Sheriff shall cause to be made such investigations as he deems necessary. If the Sheriff finds: the requirements of Sections 2212 and 2213 have been met; the conducting of said event(s), for which the license is requested at the place set forth in the application, will not violate any law or ordinance of the County of Ventura, or any law of the State of California or constitute a menace to the health, safety or welfare of the community; and the applicant is an adult sponsoring group or principal approved by the Sheriff and has not had a license revoked by the Sheriff within one (1) year prior to the application, the Sheriff may approve the application for a license, subject to the payment of all fees as required by Sections 2132 and 2214.
