Article 3 — Billiard Rooms

2241 - License required.

No person shall maintain a billiard room or knowingly permit any place under this control to be maintained as a billiard room without first obtaining a license therefor.

2242 - Definition.

"Billiard Room" is defined as any place open to the public where billiards, pool, snooker, and similar games played on any kind of pool table as a primary use or otherwise.

2243 - Exemption.

Any billiard room operated by a religious, charitable, or other non-profit organization is exempt from the requirements of this Article provided that no alcoholic beverages are permitted in the billiard room.

2244 - Application.

Any person desiring to obtain a license to maintain a billiard room shall make a written application to the Sheriff therefor, stating in addition to the information required by sections 2113-2 the following information:

(a)

The name and residence of the applicant and all other persons to be interested in the business.

(b)

The exact location of the place where the billiard room is to be maintained.

(c)

That the applicant and all other persons interested in the business are of good moral character and will not carry on such business in a manner detrimental to the morals, peace, safety and well being of the community.

2245 - Approval.

The Sheriff may disapprove the application for the license under one or more of the following circumstances:

(a)

The applicant or any other person to be interested in the business is not of good moral character.

(b)

The applicant or any other person to be interested in the business in a managerial capacity is an unfit person to manage or conduct such billiard room.

(c)

By reason of the place where such billiard room is to be located, it would be detrimental to the public health, order, or morals.

2246 - Fees.

The fee for the license is twenty dollars ($20.00) for each table upon which persons are permitted to play billiards, pool, snooker and similar games.

2247 - Intoxicated persons.

No person in charge of any billiard room shall permit any intoxicated or disorderly person to enter or remain in such room.

2248 - Hours.

Billiard rooms shall be closed to the public between 2 o'clock a.m. and 6 o'clock a.m. each day.

2249 - Minors.

Persons under the age of 18 years may be permitted in billiard rooms with the consent of their parents or guardians provided no alcoholic beverages are permitted therein. The person in charge of the billiard room shall not permit a minor under the age of 18 years to enter or remain or to be present in the billiard room between the hours of 10 o'clock p.m. and 6 o'clock a.m.

2250 - Forfeit of license.

The license of any billiard room is forfeit and void on the conviction of any person in charge of that billiard room for violation of sections 2247, 2248 or 2249 of this Article.

2251 - Coin operated tables.

The owner or person in charge of any coin operated pool table may apply to the Sheriff for a coin operated pool table license in lieu of a billiard room license for the operation of each table at a designated location. Transfers to other locations may be made upon notice to the Sheriff. The fee for each license is $20.00 per year. The person maintaining the place in which such tables with licenses are located is not required to obtain a billiard room license for such tables provided that the operation of such tables is incidental to the primary business of the place. If the operation of such tables is the primary business of the place, a billiard room license shall be obtained instead of coin operated pool table licenses for such tables.

2251-1 - Application.

The provisions of sections 2243 through 2245 and 2247 through 2250 shall apply to owners or persons in charge of any coin operated pool table with like force and effect as they apply to persons who maintain or knowingly permit any place under their control to be

maintained as a billiard room.
