Chapter 9.10 — HAZARDOUS OR INFECTIOUS WASTE

9.10.010 - Short title—Definitions.¶
This chapter is known and may be cited as the "City of Sutter Creek Hazardous and Infectious Waste Ordinance." The following words and phrases, when used in this chapter, shall, for the purposes of this chapter, have the meanings respectively ascribed to them by this section:
A.
"Department" means the state Department of Health Services.
B.
"Director" means the director of health services.
C.
"Disposal" means to abandon, deposit, inter or otherwise discard waste.
D.
"Extremely hazardous waste" means any hazardous waste or mixture of hazardous wastes which, if human exposure should occur, may likely result in death, disabling personal injury or serious illness caused by the hazardous waste or mixture of hazardous wastes because of its quantity, concentration, or chemical characteristics.
E.
"Handling" means the transporting or transferring from one place to another, or pumping, processing, storing, or packaging of hazardous waste, but does not include the handling of any substance before it becomes a waste, and does not include the storage of hazardous waste on the contiguous property of the producer of the waste.
F.
"Hazardous waste" means a waste, or combination of wastes, which because of its quantity, concentration, or physical, chemical, or infectious characteristics may either:
Cause, or significantly contribute to an increase in mortality or an increase in serious irreversible, or incapacitating reversible, illness;
Pose a substantial present or potential hazard to human health or environment when improperly treated, stored, transported, or disposed of, or otherwise managed.
G.
"Health officer" includes the health officer and any duly authorized deputy, sanitarian, or other agent of the health department of the city, and shall include duly authorized personnel of the State of California Department of Health Services in the performance of any contract between the state and the city or
applicable state law, county ordinance, city ordinance, or state, county or city rule of regulation in aid thereof.
H.
"Infectious," except as otherwise provided in Section 25117.6 of the Health and Safety Code, includes:
Pathologic specimens, tissues, specimens of blood elements, excreta or secretions and disposable articles attendant thereto from humans or animals at a hospital, medical clinic, research center, veterinary institution, or pathology laboratory;
Surgical operating room pathologic specimens and disposable articles attendant thereto which may harbor or transmit pathogenic organisms;
Pathologic specimens and disposable articles attendant thereto from outpatient areas and emergency rooms;
Discarded equipment, instruments, utensils and other articles which may harbor or transmit pathogenic organisms from the rooms of patients with suspected or diagnosed communicable disease.
I.
"Person" means an individual, trust, firm, joint stock company, corporation (including a government corporation), partnership, and association.
J.
"Processing" means to treat, detoxify, neutralize, incinerate, biodegrade, or otherwise process a hazardous waste to remove its harmful properties or characteristics for disposal in accordance with regulations established by the department.
K.
"Recycle" means to redirect or utilize a waste or a substance from a waste in a manner that, in the judgment of the department, will not result in a substantial hazard to the health or safety of persons, domestic livestock, or wildlife.
L.
"Storage" means the containment of hazardous wastes, either on a temporary basis or for a period of years, in such a manner as not to constitute disposal or use of such hazardous waste.
M.
"Use" means utilization of a hazardous waste in a manner that in the judgment of the department, will not result in a substantial hazard to the health or safety of persons, domestic livestock, or wildlife.
N.
"Waste" means any material for which no use or reuse is intended and which is to be discarded.

9.10.020 - Hazardous waste.¶
Hazardous waste shall be handled, stored, used, processed, recycled, or disposed of in accordance with Chapter 6.5, Division 20, California Health and Safety Code and regulations adopted by the department therefrom.
