Chapter 8.08 — REGULATION OF DOGS

8.08.010 - At large prohibited.

No person having possession of or an interest in any dog shall permit such dog to go free or run at large upon any public street or any other public street or any other public place or upon any enclosed lot or premises in the city, unless restrained by a leash held by the owner or person having possession thereof.

The city manager shall have the discretion to designate areas specifically prohibiting the presence of dogs. Such areas will be marked by a clearly visible sign.

8.08.020 - Biting, excreting in public places prohibited.

No person shall permit any dog in his possession to run at or bite any person or animal on any public street or in any public place or public park, or to drop excreta upon any public street, public park or place, in the city.

8.08.030 - Biting—Notice to leash—Delivered.

The chief of police or any other police officer of the city, upon receiving an affidavit from any person who has been bitten by a dog or from any person who has witnessed such occurrence shall notify the owner of such dog in writing to keep such dog at all times on the property or premises where such owner resides or on the property or premises of the person to whom the owner has given the custody of such dog, or to securely hold such dog by a leash or other device or means so as to prevent said dog from wandering, straying or getting beyond the control of its custodian.

8.08.040 - Biting—Notice to leash—Compliance required.

After the owner of such dog receives the notice provided for in section 8.08.030, the owner shall at all times thereafter keep such dog on the property or premises where such owner resides or on the property or premises where the person resides to whom the owner has given the custody of such dog, or such owner shall securely hold the dog by a leash or other device or means, to prevent the dog from wandering, straying, or getting beyond the control of the owner or custodian.

8.08.050 - At large—Seizure—Procedure.

The chief of police or any police officer and all persons employed for the purpose of enforcing this chapter are authorized and empowered to take up and impound all dogs running at large and being or found in streets or other places within the city unless under the immediate control of the owner or person having possession thereof, and to keep such dogs confined at the public pound or such other place as the chief of police may provide or designate for not less than five days unless such dog be redeemed by the payment of a pound fee of one dollar. A notice containing a description of the dog impounded shall be posted at the City Hall for at least five days. At the expiration of the five days, any dog which has not been redeemed shall be killed or otherwise disposed of by the chief of police.

8.08.060 - Violation—Penalty.

Every person who violates any of the provisions of this chapter is guilty of a misdemeanor or infraction.
