10.24.010 - Health officer—Duties—Notice of unsanitary conditions.

It is the duty of the health officer to serve written notice upon any and all persons, residents of the city, who maintain or permit on their premises or permit to accumulate upon the half of any street or alley contiguous thereto, any filth or rubbish, or any deposit of excrement or other filth, or permit such premises or the half of any street or alley contiguous thereto to become in any manner in a filthy, unhealthy or unsanitary condition, notifying such persons of the condition of their premises or of the half of the street or alley contiguous thereto. It is furthermore made the duty of the health officer to prosecute any and all persons neglecting or refusing to abate any of the nuisances mentioned in this section.

10.24.020 - Allowing accumulation of filth prohibited.

Any and all persons who maintain or permit on their premises, or permit to accumulate upon the half of any street or alley contiguous thereto, any filth or rubbish or any deposit of excrement or other filth, or permit any street or alley contiguous thereto to become in any manner in a filthy, unhealthy or unsanitary condition, are guilty of a misdemeanor, and each day that any and all persons maintain or permit any of the aforesaid nuisances to exist, after having been notified by the health officer, shall be deemed a separate and distinct offense.

10.24.030 - Health officer—Duties—Disinfection and fumigation.

It shall be the duty of the city health officer to cause to be disinfected or fumigated all buildings of whatsoever kind which in his judgment may require disinfection or fumigation.

10.24.040 - Disinfection and fumigation—Owner responsibility.

It shall be the duty of any owner or lessee of a building required to be disinfected or fumigated by the city health officer to disinfect or fumigate said building forthwith in accordance with the orders and instructions of the city health officer. Any owner or lessee of a building required to be disinfected or fumigated by the health officer, failing to do so, is guilty of a misdemeanor.

10.24.050 - Quarantine—Disobeying misdemeanor.

Any person or persons refusing to obey the orders of the city health officer in all cases of quarantine or removal of any person or persons afflicted with a contagious or infectious disease is guilty of a misdemeanor.

10.24.060 - Health officer—Duties—Inspection—Cleansing.

It is the duty of the city health officer to inspect the premises of every street, alley or vacant lot within the limits of the city at least once every month, and in case that he finds that any of the premises or the half of any street, alley, or highway contiguous thereto have upon them any filth or rubbish or any deposit of excrement or other filth, he shall give written notice to the owner or occupant of such premises to remove the same, and if the same be not removed within three days thereafter, he shall cause it to be done and such premises thoroughly cleansed at the expense of the owner or occupant, and the health officer shall at the request of any citizen examine any premises and cleanse the same or see that such cleansing is properly and effectively done.

10.24.070 - City attorney responsibilities.

The city attorney is ordered to draw all notices and perform all legal services required by the city health officer in carrying out any of the provisions of this chapter, and he is ordered to enter suit against all persons for the expense incurred by the health officer in carrying out the provisions of sections 10.24.010, through 10.24.070, 10.32.010 and 10.32.020, together with costs of suit and an attorney's fees to be paid at such times and in such amounts as shall hereinafter be set forth by the city council from time to time by resolution.

10.24.080 - Service of notice.

If the health officer cannot find the owner or occupant of any premises within the limits of the city for personal service of the notice hereinbefore mentioned, such notice may be delivered by posting the same upon some conspicuous place on such premises for a period of five days before the commencement of any action.

10.24.090 - Meat, fish, poultry—Putrid or diseased—Sale or gift prohibited.

It is unlawful for any person to sell or offer for sale or to use or give away within the city, any meat, poultry, fish or game, which is either wholly or partly putrid, decomposed or diseased.

10.24.120 - Health officer—Enforcement.

The city health officer is authorized and empowered and it shall be his duty to enforce the provisions of sections 10.24.090 through 10.24.110 and 10.32.030—10.32.080, inclusive, of this title, and to pursue any and all remedies and measures necessary to carry out the provisions thereof.
