12.28.170 Coordination with hazardous materials inventory and response program. The first revision of the business plan for any facility subject to County Code Chapter 7.90 (Hazardous Materials Release Response Plans and Inventories) shall include a program for compliance with this chapter, including the prohibitions on illicit discharges, and the requirement to reduce stormwater pollutants to the maximum extent practicable. 13.04.010 Sewer connection required. Every building where people reside, congregate or are employed shall be connected to the public sewer system maintained by the sanitary district, or other authority, having such jurisdiction within the town; provided, however, that the town council, in appropriate cases, may authorize the installation of a private septic tank system, but only as follows:
(1) In cases where such installation and maintenance of a private system is permitted by the sanitary district, or other authority, having jurisdiction within the town; . (2) Only after the town council has granted a variance and exception following all of the procedures, hearings, findings, etc. specified in Chapter 18.48 of this code. 13.04.020 General requirements for septic tanks. When a public sewer is not available and a septic tank system is permitted under the provisions of Section 13.04.010, application may be made to the town building and planning director or their designee for a permit for connection to a private septic tank. The application shall be accompanied by three sets of construction plans and specifications complying with septic tank standards set forth by the county, and such conformity shall be evidenced by the certificate of a registered civil engineer engaged at the expense of the applicant. Such plans and specifications shall be forwarded to the health officer of the county for approval. Septic tanks shall be constructed in accordance with the approved plans and specifications and shall be subject to inspection by the county health officer and the town building and planning director or their designee before a final occupancy permit is issued. 13.04.030 Regulations for existing septic tanks. All existing septic tanks shall be maintained in a safe and satisfactory operating condition in accordance with the ordinances and standards of the county. Upon being advised by the county health department that any septic tank within the town has become overloaded, is functioning improperly or that proposed enlargement of the building served will result in overloading the septic tank, the town may require abandonment, alteration or repair of the septic tank to correct such condition. 13.04.040 Street pavement cut permits and repair fees. Wherever it is necessary to cut, remove or in any way damage the pavement of a town street in connection with the installation, inspection or construction of a sewer connection or any other facility, a permit shall first be secured from the town building department, all in accordance with Chapter 12.04 of this code. (Ord. 408 §l(part), 1979).
13.04.050 Prohibitions. It is declared to be a nuisance and it is unlawful for any person to do any of the following:
(1) Construct, rebuild, use, occupy, or maintain any residence, place of business, or other building or place where persons reside, congregate or are employed, which is not provided with means for the disposal of sewage by connection to a public sewer system as specified in Section 13.04.010 of this chapter;
(2) Construct, enlarge, alter, repair, improve or replace a septic tank, seepage pit, cesspool, drainage field, leaching system, or any other type of individual sewage disposal system or any part thereof without first securing a permit from the town building department in accordance with Section 13.04.020;
(3) Install or place a chemical toilet in or upon any property for any purpose other than for temporary use in connection with the construction of a building or other structure, during the period of such construction;
(4) Discharge sewage into a waterway;
(5) Dump or throw garbage into a waterway;
(6) Connect any storm water drain or swim pool drain to any pipe which is directly or indirectly connected to the public sewer system;
(7) Deposit or place into any sewage system any ashes, sand, rags, wood, unduly large quantities of paper or any substance of any kind tending to obstruct or injure said system. (Ord. 408 §1(part), 1979).
