15-57 Types Of Appointments

The city manager may fill vacancies in the classified service by transfer, demotion, reemployment, reinstatement, or from “eligibles” from an appropriate employment list or by advertising. In the absence of persons eligible for appointment, the city manager may make transitory appointments in accordance with these personnel rules. (Res. No. 7-7-87-2, Rule VII, (part).)

15-58 Notice To City Manager

If a vacancy in the classified service arises, the personnel director shall notify the city manager. The city manager may fill the vacancy by reinstatement, transfer, demotion, appointment from a promotional employment list, or appointment from an open employment list or by advertising. (Res. No. 7-7-87-2, Rule VII, (part).)

15-59 Certification Of Eligibles

  1. If the city manager does not consider it in the city’s best interest to fill the vacancy by reinstatement, transfer, or demotion, or if it is not possible to fill the vacancy be reemployment or advertising, the city manager may select an eligible person from an appropriate employment list.
  1. The city manager may request a vacancy be filled by appointment from a promotional employment list or from an open employment list the city manager shall instruct the personnel director to select the names of all individuals willing to accept appointment form appropriate employment lists. Whenever fewer that three individuals are willing to accept appointment on a promotional employment list, or on an open employment list, the city manager may make an appointment from among such eligibles or may request the office manager to establish a new list. Thereafter, the city manager shall hold a new examination and establish a new employment list. (Res. No. 7-7-87-2, Rule VII, (part).)

15-60 Appointment

After interview and investigation, the city manager and department head shall immediately notify the personnel director of the persons appointed. The person accepting appointment shall report to the personal direct or the city manager for processing, on or before the date of appointment. If the applicant accepts the appointment and reports for duty within such period of time as the city manager sets forth, the applicant shall be deemed to be appointed; otherwise, the applicant shall be deemed to have declined the appointment. (Res. No. 7-7-87-2, Rule VII, (part).)

15-61 Transitory Appointment

  1. In the absence of individuals willing to accept appointment from appropriate employment lists or through appropriate advertising methods, the city manager may take a transitory appointment of a person meeting the minimum training and experience qualifications for the position. The city manager may make such an appointment during the period of suspension of an employee or pending final action on proceedings to review suspension, demotion or discharge of an employee. The city manager may fill such vacancy subject to the provisions of this chapter and the personnel rules. The city manager may remove a transitory employee at any time without the right of appeal or hearing. No transitory appointment shall exceed six months.
    1. Transitory appointees shall accrue the same benefits as provisionary employees. If a transitory appointee is selected for a full-time position, in the same class, the time served as a transitory appointee may be counted as time toward the fulfillment of the required provisionary period. If the transitory appointee, however, is selected for a full-time position in a different classification, the appointee shall then be in a provisionary period.
    2. A transitory employee shall not receive special credit with respect to qualifications, examinations or promotional lists. (Res. No. 7-7-87-2, Rule VII, (part).)
