15-62 Regular Appointment Following Provisionary Period
All original and promotional appointments in the classified service shall be tentative. Such appointments are subject to a provisionary time period of not less than six months actual service, or a longer time period to be determined for each position by the city manager. The city manager may extend a provisionary period for up to six additional months. The personnel director shall notify the city manager, and the provisionary employee concerned, two weeks prior to the termination of any provisionary period. If the service of the provisionary employee has been satisfactory to the city manager, the city manager shall give the personnel director w
written statement to that effect. The statement shall also recite that the retention of such employee is acceptable. If the city manager does not prepare such a statement, the employee will be deemed to be unsatisfactory and his or her employment shall terminate at the expiration of the provisionary period. If the city manager does not prepare a statement of satisfactory service, the appropriate department head or the city manager shall serve notice of termination on the employee. (Res. 15-63 Objective Of Provisionary Period
The provisionary time period shall be regarded as a part of the selection process. The provisionary employee’s supervisor shall use the time period for closely observing the employee’s work and for securing the most effective adjustment of a new employee to his position. (Res. 15-64 Rejection Of Provisioner
During the provisionary period, an employee may be rejected at any time by the city manager, without cause and without the right of appeal. Notification of rejection by the appropriate department head or city manager shall be personally served on the provisioner. (Res. No. 7-7-87-2, Rule VIII, (part).)
15-65 Rejection Following Promotion
- An employee may be rejected during or at the end of the provisionary period following a promotional appointment. In such event, the employee may be reinstated to the position from which he or she was promoted. The employee shall not be so reinstated if charges have been filed against him or her and he or she is discharged pursuant to these rules or the personnel ordinance.
- By the same token, the employee shall not be so reinstated to the position from which he or she was promoted if no vacancy exists in that position. In such event, the employee may request his or her name be placed on a reemployment list. (Res. No. 7-7-87-2, Rule VIII, (part).)
