5-1 License -- Required
It shall be unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys or public highways of the city, without first obtaining from the police department a license, therefore. (Ord. No. 217-NS)
5-2 Same -- When Payable; Issuance
The police department is hereby authorized and directed to issue, upon written application bicycle licenses. Such licenses when issued shall entitle the licensee to operate such bicycle for which the license has been issued upon all the streets, alleys and highways, exclusive of the sidewalks thereof, in the city. Such license shall be effective from the date of issuance until a subsequent sale or transfer of the bicycle. (Ord. No. 217-NS; Ord. No. 24-AC)
5-3 Same -- Fee; Transfer; Duplicate
For each license issued pursuant to this chapter, the sum of one dollar shall be paid in advance. Upon a transfer of the ownership of a bicycle a new license shall be applied for, and the sum of one dollar shall be paid in advance for the new license. There shall be the sum of one dollar paid in advance for the issuance of a duplicate license in the event of a lost, destroyed or mutilated license. (Ord. No. 217-NS; Ord. 24-AC)
5-4 Same -- Issuance Of Registration Certificates, License Plates, Etc.; Records To Be Kept
The city shall provide license plates or other means of identification, as approved by the city council, together with a registration certificate for licenses issued under this chapter. Such license plates or other means of identification as selected by the city council shall be suitable for the attachment upon the frames of bicycles, and it shall be the duty of the police department to attach or impress such license plates or other means of identification to the frame of each bicycle and to issue a corresponding registration certificate to the licensee upon the payment of the license fee provided for in this chapter.
Such license plate or other means of identification shall remain attached or impressed during the existence of such license. The police department shall also keep a record of the date of issuance of each license, to whom issued and the number thereof. (Ord No. 217-NS; Ord. No. 24-AC)
5-5 Daily Reports Of Bicycle Dealers Required
Every person engaged in the business of buying or selling new or secondhand bicycles is hereby required to make a daily report to the chief of police specifying the following:
- The name and address of the person from whom each bicycle is purchased or to whom sold.
- The description of each such bicycle by name or make.
- The frame number thereof, and the number of the license plate, if any, found thereon. (Ord. No. 217- NS)
5-6 Reporting Of Sales, Etc., Of Bicycles Required
It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer by returning to the police department the registration certificate issued to such person as licensee thereof, together with the name and address of the person to whom the bicycle was sold or transferred, and such report shall be made within five days of the date of such sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer of registration therefore within five days of such sale or transfer.
5-7 Alteration, Mutilation, Etc., Of Frame Numbers, License Plates, Etc.
It shall be unlawful for any person to willfully and maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this chapter. It shall be unlawful for any person to remove, destroy, mutilate or alter any license plate, seal or registration certificate during the time in which such license plate, seal or registration card is operative; provided, that nothing in the chapter shall prohibit the police department from stamping numbers and symbols on the frames of bicycles on which no serial number can be found, or on which such number is illegible or insufficient for identification purposes. 5-8 Impounding Of Unlicensed Bicycles
In addition to any penalty imposed for a violation of this chapter, the police department or any members thereof may impound and retain possession of any bicycle operated in violation of any of the provisions of this chapter and retain possession of the same until the license therefore is obtained by the owner of such bicycle. 5-9 Requirements And Restrictions For Riding Of Bicycles
No person shall ride or park or leave a bicycle upon any sidewalk. The rider of a bicycle upon a roadway shall ride as nearly as practicable within five feet of the right hand curb or edge of the roadway, except when passing a standing vehicle or making a left hand turn at an intersection.
No operator of any bicycle when upon the street shall carry any other person upon the bar, handle or tank of any such vehicle, and no person shall so ride upon any such vehicle. (Ord No. 257-NS)
