The terms used in Articles II through XVII of this chapter shall have the meanings defined in this article.

15-16 Advancement

“Advancement” means a salary increase within the pay range established for a position. (Res. No. 7-7-87-2, Rule I, (part).)

15-17 Allocation

“Allocation” means the assignment of a single position to its proper “class” in accordance with the duties performed, and the authority and responsibility exercised. (Res. No. 7-7-87-2, Rule I, (part).)

15-18 Appointing Authority

“Appointing authority” means as follows: the city manager has the final authority to make the appointment to the position to be filled. (Res. No. 7-7-87-2, Rule I, (part).)

15-19 Class

“Class” means all positions sufficiently similar in duties, authority and responsibility, to permit grouping under a common title, and permit equitable application of common standards of selection, transfer, demotion and salary. (Res. No. 7-7-87-2, Rule I, (part).)

15-20 Classified Service

“Classified service” means all positions of employment in the service of the city except those excluded by the personnel ordinance. (Res. No. 7-7-87-2, Rule I, (part).)

15-21 Days

“Days” means calendar days unless otherwise stated. (Res. No. 7-7-87-2, Rule I, (part).)

15-22 Demotion

“Demotion” means the movement of an employee from one position to another position having a lower maximum base rate of pay. (Res. No. 7-7-87-2, Rule I, (part).)

15-23 Disciplinary Action

“Disciplinary action” means the discharge, demotion, reduction in pay or a temporary suspension without pay of a regular employee, for cause. (Res. No. 7-7-87-2, Rule I, (part).)

15-24 Eligible

“Eligible” means a person whose name is on an employment list and meets the minimum qualifications required. (Res. No. 7-7-87-2, Rule I, (part).)

15-25 Employment List

“Employment list” means as follows in this section:

  1. “Open employment list” means a list of names of persons who have taken an open-competitive examination for a position in the classified service and who have qualified.
  2. “Promotional employment list” means a list of names of persons who have taken a promotional examination for a position in the classified service and who have qualified. (Res. No. 7-7-87-2, Rule I, (part).)

15-26 Examination

“Examination” means as follows in this section:

  1. “Open-competitive examination” means an examination for a particular position which is open to all person meeting the qualifications for the class. (Res. No. 7-7-87-2, Rule I, (part).)
    1. “Promotional examination” means an examination for a particular position which is open only to employees meeting the qualifications for the class. (Res. No. 7-7-87-2, Rule I, (part).)

15-27 Layoff

“Layoff” means the separation of employees from the active work force because of lack of work or funds, or abolition of positions by the city council because of lack of work or funds or because of organizational changes. (Res. No. 7-7-87-2, Rule I, (part).)

15-28 Personnel Ordinance

“Personnel ordinance” means Ordinance No. 290-AC, codified in Article I of this chapter, which creates a personnel “system” for the city. (Res. No. 7-7-87-2, Rule I, (part).)

15-29 Position

“Position” means a group of duties and responsibilities in the classified service, requiring full-time or part- time employment of one person. (Res. No. 7-7-87-2, Rule I, (part).)

15-30 Provisional Period

“Provisional period” means a length of time considered as an integral part of the examination, recruiting, testing and selection process. During the provisional period, an employee is required to demonstrate fitness for the position to which the employee is appointed, by actual performance of the duties of the position. (Res. No. 7-7-87-2, Rule I, (part).)

15-31 Promotion

“Promotion” means the movement of an employee from one position to another position having a higher maximum base rate of pay. (Res. No. 7-7-87-2, Rule I, (part).)

15-32 Transitory Appointment

“Transitory appointment” means an appointment, to a certain position, of a person who possesses only the minimum qualifications established for that particular position. The person is so appointed to that position because of the absence of available eligible persons. A transitory appointment shall not exceed six months. (Res. No. 7-7-87-2, Rule I, (part).)

15-33 Regular Employee

“Regular employee” means an employee in the classified service who has successfully completed the provisional period and has been retained pursuant to these rules. (Res. No. 7-7-87-2, Rule I, (part).)

15-34 Reinstatement

“Reinstatement” means the restoration without examination, of a former regular employee or provisionary employee, to a classification in which the employee formerly served as a regular employee. (Res. No. 7-7-87-2, Rule I, (part).)

15-35 Relief Of Duty

“Relief of duty” means the temporary assignment of an employee to a status of leave with pay or without pay. (Res. No. 7-7-87-2, Rule I, (part).)

15-36 Suspension

“Suspension” means the temporary separation from service of an employee without pay for disciplinary purposes. (Res. No. 7-7-87-2, Rule I, (part).)

15-37 Temporary Employee

“Temporary employee” means an employee who is hired for a limited period of time. (Res. No. 7-7-87-2, Rule I, (part).)

15-38 Transfer

“Transfer” means a change of an employee from one position to another position in the same class or another class. (Res. No. 7-7-87-2, Rule I, (part).)
