2.94.010 - Commissions.¶
There are in the unclassified civil service of the county the following commissions, the members of which shall serve without compensation, except as specified in this chapter: Albany veterans' memorial building commission; Hayward veterans' memorial building commission; San Leandro veterans' memorial building commission; Washington Township veterans' memorial building commission.

2.94.020 - Veterans' memorial building commissions—Composition of commissions.¶
The commissions shall be composed of representatives from associations or organizations of veteran soldiers, sailor or marines who have served the United States honorably in any of its wars and who are organized for patriotic, fraternal and benevolent objects, as specified in this chapter. The composition of each veterans' memorial building commission listed in Section 2.94.010 shall be established by resolution of the board of supervisors and may be changed by the board upon its own motion or upon a formal request by a majority of the veterans' memorial commission for each building. Any requests by individual organizations for a change in the building commission representation shall be referred to the appropriate commission for a recommendation prior to board action thereon. Commission members shall be residents of the county.

2.94.030 - Appointment of members.¶
Members of each commission shall be nominated by the organizations named in this chapter as being eligible to contribute members to the respective commissions. These nominations shall be submitted to the incumbent commission for each building. Nominations shall then be forwarded to the board of supervisors by the incumbent commission, as submitted by the nominating organizations, except in cases wherein more than one nomination is received for a single seat on the commission. In these cases, the commission shall, by majority vote, select one nomination to be forwarded to the board of supervisors. In no case shall the commission submit more than one nomination for each seat to the board of supervisors. The commission shall be appointed by the board of supervisors, based upon these nominations.

2.94.040 - Veterans' memorial building commissions—Member terms.¶
Each member shall hold office for a term of three years commencing on the first day of July, 1966, and on the first day of July every three years thereafter. However, each commissioner shall continue in office until the board of supervisors appoints a successor.

2.94.050 - Removal of members.¶
Each member during his respective term of office may be removed at the pleasure of the board of supervisors upon the board's own motion or upon the recommendation of a majority of the members of the commission to which he is appointed.

2.94.060 - Building superintendent—Ex officio member of commissions—Another may be appointed in his stead.¶
The building superintendent shall be an ex officio member of the commissions. The board of supervisors may, by resolution, designate some other county employee to act in the place and stead of the building superintendent as a member of the commissions.

2.94.070 - Filling of vacancies.¶
Vacancies occurring in the commissions shall be filled for the unexpired term in the same manner as the original appointment.

2.94.080 - Powers and duties of commissions.¶
Subject to the supervision and control of the board of supervisors, each commission shall:
A. Name members of the commission to act as a chairman, a vice-chairman, a secretary, and such other officers and committees as may be required;
B. Hold commission meetings at regular intervals;
C. Adopt, maintain and use a uniform system of accounting and settlement to be installed by the county auditor;
D. Require all monies collected, including donations received, to be transmitted to the county treasurer daily. The county treasurer and the county auditor shall credit the appropriate trust fund with the amount so paid and apply it to the cost of maintenance and operation of that building in accordance with Section 2.94.100 of this chapter;
E. Submit a regular monthly report to the county auditor showing accounts and collections during the preceding month;
F. Make no expenditures for any purpose; all expenditures shall be made by the board of supervisors in accordance with law.

2.94.090 - Powers and duties of commissions.¶
Subject to the supervision and control of the board of supervisors, each commission shall also:
A. Administer the veterans' memorial building for which the commission is named in accordance with law and this chapter for the use and benefit of associations or organizations of veteran soldiers, sailors or marines who have served the United States honorably in any of its wars and who are organized for patriotic, fraternal and benevolent objects;
B. Be responsible for the security of the building and the careful and prudent use thereof, and establish all necessary rules and regulations therefor;
C. Determine what associations or organizations are entitled and qualified under the law to occupy meeting rooms and other space in the building; and allocate among those associations or organizations rooms and space and the times of use thereof;
D. Prohibit the use of the building, equipment or grounds by persons, associations, organizations or enterprises not authorized by law to use the same; provided, however, that each commission shall provide for the use of such facilities by persons or organizations other than veterans to aid in the cost of maintenance, for any purpose, not inconsistent with the continued use thereof by veterans' associations but not only when such use will not unduly interfere with the reasonable use of such facility by veterans' associations and subject to the following conditions:
The veteran and nonveteran groups shall hold the county, its officers, boards and commissions, harmless as a result of such use;
That rents shall be charged that are at least equal to charges for privately owned space of like character in the area; provided, however, that such rental, exclusive or custodial charges as may be required, shall be waived by the general services agency for any public agency which requests a waiver, when such use will be for the benefit of the county; and provided further that the commission shall not be required to rent space to nonveteran groups when such rental will result in a net loss of revenue;
That rentals received from nonveterans groups shall be deposited in the county treasury pursuant to Section 2.94.080 hereof.
E. Require all requests for reservations of rooms and facilities to be submitted in writing, which shall state the purpose of the reservation. Requests shall be acted upon by the commission at its next regular meeting and a record thereof, with rentals to be charged, shall be contained in the minutes of the meeting. If there is no meeting of the commission before the date of reservation so requested, the secretary shall consult the other members of the commission and shall rectify and record such action at its next regular meeting.

2.94.100 - Cost of maintenance, etc. of buildings—How appointed—Credit for overpayments.¶
As a matter of policy, the maintenance and operation costs of veterans' memorial buildings and grounds shall be borne as follows: not to exceed one-half of the cost shall be borne by the participating veterans' organizations in proportion to their use of the building, and the balance thereof shall be borne by the county. The portion of the cost to be borne by such participating organizations shall be appointed among the organizations using the building by the commission in charge of the building, except that whenever in any year any commission deposits with the county treasury money available to pay the maintenance and operation costs of the building under its jurisdiction which is in excess of one-half of the cost, then the excess shall be available at all times, until used to pay one-half of the cost, as credit to the commission for that purpose. When rentals are waived as permitted under Section 2.94.090D, the applicable veterans' memorial buildings shall receive a credit in an amount equal to the amount the rental would have been if said subsection were not applied.
