2.42.010 - Recognition.

There is in the county a probation department, hereafter in this chapter referred to as the department.

2.42.020 - Executive officer.

The executive officer of the department is the probation officer, appointed as provided by the Charter in the manner and for the term now or hereafter provided by state law.

2.42.030 - General powers and duties.

The probation officer shall have the powers and perform the duties now or hereafter prescribed by state law and ordinances not inconsistent therewith, which duties shall include, but not by way of limitation:

A. To maintain the Juvenile Hall, Probation Center, juvenile camps, and other juvenile facilities now or hereafter established in the county and subject to jurisdiction of the department;

B. To investigate and recommend action to be taken with regard to all children in Alameda County whose conduct, habits, attitudes, arrest or manner of living are the reasons for complaints, reports or referrals to the department;

C. To investigate the cases of all children in Alameda County concerning whom reports are made that the homes of such children are unfit or improper, or that such children are neglected, abused or cruelly treated by parents, guardians or custodian;

D. To assume responsibility for children adjudged wards or dependent children of the Juvenile Court as directed by court order, and to administer programs for the care, treatment, training, protection, education and supervision of such wards;

E. To assist in the prosecution of persons who cause children to become wards of the Juvenile Court;

F. To investigate and make recommendations with regard to persons convicted of misdemeanors and felonies;

G. To supervise, enforce conditions of probation, and administer rehabilitative programs to probationers;

H. To investigate complaints and supervise court decisions on civil actions relative to the Reciprocal Enforcement of Support Act;

I. To investigate and make recommendations with regard to persons accused of misdemeanors and felonies.

J. To perform assessment and monitoring duties associated with the department's participation in any pretrial program, which constitute law enforcement activity designed to maintain public peace, protect life and property from accidental or willful injury, and prevent and detect crimes.

2.42.040 - Juvenile justice commission.

There is a juvenile justice commission, appointed in the manner and for the terms now or hereafter provided by state law.

2.42.050 - Powers, duties and compensation.

The juvenile justice commission shall inquire into the administration of the juvenile court law in the county; and shall annually inspect any jail or lockup within the county which in the preceding calendar year was used for confinement of more than twenty-four (24) hours of any minor under the age of eighteen (18) years. It shall report the results of such inspection, together with its recommendations based thereon, in writing to the Juvenile Court and to the youth authority. Each commissioner shall receive the sum of fifteen dollars ($15.00) for each meeting of the commission attended by him in lieu of the actual and necessary expenses incurred by him in the performance of his duties not to exceed two meetings per month or twelve (12) meetings per year, provided, however, that such sums shall be paid only to commissioners filing a statement with the county requesting such compensation.

2.42.060 - Delinquency prevention commission established.

Pursuant to and in accordance with Section 535.5 of the Welfare and Institutions Code, there is established in the county of Alameda a delinquency prevention commission to coordinate on a county-wide basis the work of those governmental and nongovernmental organizations engaged in activities designed to prevent juvenile delinquency.

2.42.070 - Membership of commission.

The delinquency prevention commission consists of eighteen (18) members to be appointed by the board of supervisors. Eight of these members shall be appointed from nominations made by the Superior Court. This method of appointing commission members shall become effective as the terms of the members of the current commission expire and as vacancies otherwise occur. The board of supervisors shall designate which positions on the commission are to be nominated by the Superior Court.

2.42.080 - Juvenile camps—Establishment.

There are established juvenile camps in the county of Alameda, state of California, as hereinafter designated: Chabot; Los Cerros; Week-end Training Academy; and such other camps or homes as are now or hereafter authorized by the board of supervisors.

2.42.090 - Purpose.

The juvenile camps are established to provide appropriate facilities for the housing or training of wards of such of the Juvenile Court in the county so that such wards may be kept under direct supervision of the Juvenile Court, and in order to more advantageously apply the salutary effect of home and family upon them, and also in order to secure a better classification and segregation of such wards according to their capacities, interests and responsiveness to control and responsibility, and give better opportunity for reform and encouragement of self-discipline in such wards.

2.42.100 - Duties of probation officer—Director.

The probation officer shall manage and control the internal affairs of the Alameda County juvenile camps. A director who shall be in charge of each camp, and other persons employed at the Alameda County juvenile camps, shall be appointed by the probation officer of the county.

2.42.110 - Commitments to camps.

Minors who are adjudged wards of the court may be committed by the court to the Alameda County juvenile camps, or homes, as prescribed by state law.

2.42.120 - Labor, studies or other activities by wards.

The wards committed to the Alameda County juvenile camps, or directed to report for work as directed by the court, may be required to labor on the buildings and grounds thereof, or to perform other work or engage in any studies or activities on or off the grounds of such camps prescribed by the probation department.

2.42.130 - Wages.

Subject to approval of the board of supervisors, wages may be paid from the county treasury to the wards for work they do, the sums earned to be paid in reparation, or to the parents or dependents of the ward, or to the ward himself, in such manner and such proportion as the Juvenile Court directs.

2.42.140 - Minimum standards and qualifications.

The minimum standards of construction, operation, programs of education and training and qualifications of personnel for juvenile camps adopted and prescribed by the Youth Authority of the state shall be complied within the establishment, operation and maintenance of the Alameda County juvenile camps.

2.42.150 - Maximum number of wards.

A juvenile camp shall not receive or contain more than one hundred (100) wards at any one time.

2.42.160 - Establishment and maintenance of public schools.

The superintendent of schools shall establish and maintain a public school of such grade or grades as may be, in his judgment, necessary, pursuant to the provisions of Section 889 of the Welfare and Institutions Code of the state, in such juvenile camps.

2.42.170 - Selection and training standards.

While receiving any state aid pursuant to Article 3, commencing with Section 6040 of the California Penal Code, the county will adhere to the standards for the selection and training of probation officers established by the Board of Corrections. Notwithstanding anything herein to the contrary, the board of supervisors reserves the right to repeal this section at any time due to the insufficiency of state aid to fund the selection and training program.

The provisions of Section 1203.1b of the Penal Code providing for reimbursement of the cost of probation services are hereby operative in the county.

2.42.180 - Selection and training standards.

Notwithstanding anything herein to the contrary, the board of supervisors reserves the right to repeal this section at any time due to the insufficiency of state aid to fund the selection and training program.

2.42.190 - Probation department fees.

Notwithstanding any prior county ordinance or resolution of the Board of Supervisors to permit assessment of probation fees and costs under California Penal Code Section 1203.1b, neither the probation department nor any other county agency shall assess fees for probation services, or any other fees or costs authorized by Penal Code Section 1203.1b.
