Sec. 1-2-70. - Establishment of Department and its Director.

Pursuant to section 17304 of the Family Code of the State of California, there is hereby established in the County a Department of Child Support Services, the Director of which shall be a County employee selected by the Board of Supervisors pursuant to the qualifications established by the State Department of Child Support Services. The Director shall report directly to and serve at the pleasure of the County Executive Officer.

Sec. 1-2-71. - Duties of the Director.

The duties and responsibilities of the Director of Child Support Services shall be established by the Board of Supervisors, which may include the authority to hire staff, including attorneys, in conformity with any staffing requirements adopted by the State Department of Child Support Services.

Sec. 1-2-72. - Responsibilities of the Department.

The Department of Child Support Services shall be responsible for promptly and effectively establishing, modifying, and enforcing child support obligations, including medical support, enforcing spousal support orders established by a court of competent jurisdiction, and determining paternity in the case of a child born out of wedlock, as required by state and federal laws and regulations, or as directed by the Board of Supervisors.

Sec. 1-2-73. - Transition plan for, and transfer of functions and duties to,…

(a) On or before July 1, 2002 the County's transition plan for the transfer of programs, employees and assets of the District Attorney's Family Support Division to the Department of Child Support Services shall be submitted to and approved by the Director of the California Department of Child Support Services.

(b) Effective July 1, 2002, the programs, employees and assets of the District Attorney's Child Support Division used for and dedicated to the performance of civil child support collection and enforcement services shall be transferred to the Department of Child Support Services.
