Sec. 5.439.1. Creation and Administration of the Fund.

(a) There is hereby created within the Treasury of the City of Los Angeles a Fund, which is known as the “ Ernani Bernardi Scholarship Trust Fund”, referred to in this chapter as the “Fund”.

(b) The Fund shall be administered by the Office of the City Clerk.

Sec. 5.439.2. Purpose of the Fund.

The Fund is established as an endowment fund with the interest earnings of the Fund to be used for scholarship awards. The awards shall be used for the purpose of financing a portion of the educational expenses of qualified residents attending eligible Higher Education Institutions as defined in Section 5.439.5 of this Chapter.

Sec. 5.439.3. Interest Bearing Fund.

The Fund shall be interest bearing, and the accrued interest shall be deposited into the Fund and into a separate account therein. None of these funds shall revert to the General Fund.

Sec. 5.439.4. Geographical Boundaries.

Students eligible to receive scholarships from the Fund must reside in the City of Los Angeles within the geographic area included within the following boundaries: Beginning at the projection of the centerline of Wheatland Avenue and the Angeles National Forest boundary, then along the centerline of: Wheatland Avenue, the Foothill Freeway (210), Foothill Boulevard, Osborne Street, Glenoaks Boulevard, Osborne Place, Osborne Street, San Fernando Road, Hubbard Street and Gavina, Tibbetts Street, and the projection of the centerline of Tibbetts Street to the closest point on the City/County boundary, along the City/County boundary and the boundary of the Angeles National Forest to the point of beginning.

Sec. 5.439.5. Nomination of Scholarship Candidates.

Eligible higher education institutions are defined as all colleges and universities that have been recognized by the United States Department of Education as higher education institutions. Enrolled students who reside within the Geographical Boundaries defined in Section 5.439.4 of this Chapter and who are attending any higher education institution shall be eligible for scholarships from the Fund. To be eligible for consideration for a scholarship, all nominees shall also meet their higher education institution’s guidelines for scholarship and financial assistance. Selection of the recipients for scholarship awards shall be made by the awards panel.

Sec. 5.439.6. Awards Panel.

The awards panel shall consist of seven (7) members from the local community, including local business leaders, community leaders, and educators who shall be selected by the Office of Council District 7. The awards panel shall be responsible for administering the selection of

eligible participants and recommending recipients for scholarships to the Councilmember representing the Office of Council District 7. The Office of Council District 7 shall provide scholarship selection criterion recommendations to the awards panel, in addition to providing logistical and administrative support.

Sec. 5.439.7. Disbursement of the Funds.

All monies held in the Fund shall be disbursed pursuant to Section 5.439.6 and approved by City Council. Awards shall be disbursed by the Office of the Controller to the respective higher education institution for the credit of or payment to the awardees, subject to the submission of any requested documentation.

Sec. 5.439.8. Closing of the Fund.

Upon the complete disbursement of the monies held in the Fund pursuant to Section 5.439.7, the awards panel shall dissolve and the Fund shall be closed by the Office of the Clerk or such other relevant office or department. This chapter shall remain in effect until 6 months after the closure of the Fund, and as of that date is repealed.
