Sec. 5.506. Creation and Administration of the Fund.¶
(a) There is hereby created and established in the Treasury of the City of Los Angeles a special fund to be known as the “Unified Program Trust Fund”, hereinafter referred to in this chapter as the “Fund”.
(b) The purpose of the Fund is to receive that portion of fees collected by the City of Los Angeles, through its Fire Department, in its capacity as:
- The Certified Unified Program Agency, or CUPA, for the City of Los Angeles pursuant to Health and Safety Code Section
25404 and following which has been established by the Secretary of the California Environmental Protection Agency, pursuant to Health and Safety Code Section 25404.5, as a surcharge to cover the necessary and reasonable costs incurred by state agencies in carrying out their responsibilities under the program;
- An oversight administrator of the County of Los Angeles, as a participating agency under the Certified Unified Program Agency,
to collect, pursuant to an agreement between the City and the County, all fees due and owing the County in connection with its
enforcement of the Hazardous Waste Generator Program and the Hazardous Waste Generator Onsite Treatment activities authorized pursuant to Health and Safety Code, Division 20, Chapter 6.5;
(c) Surcharge revenues deposited in the Fund, including the surcharge on moneys collected on behalf of the County of Los Angeles, shall be transmitted to the Secretary of the Environmental Protection Agency on a quarterly basis. Moneys due and owing the County of Los Angeles shall be transmitted on a regular basis.
(d) The Fund shall be administered and expenditures shall be authorized by the Chief Engineer and General Manager of the Fire Department or the Chief Engineer and General Manager’s designee.
(e) All interest and other earnings attributable to monies in the Fund shall revert to the General Fund.
