Sec. 5.505. Creation and Administration of Fund.

(a) There is hereby created within the Treasury of the City of Los Angeles a special trust fund known as the “ Elected Charter Reform Commission Trust Fund,” hereinafter referred to in this chapter as the “Fund.”

(b) The purpose of the Fund shall be for the receipt, retention and disbursement of gifts, contributions and bequests for the support of the elected Charter Reform Commission established by the voters of the City of Los Angeles at the April 8, 1997 Primary Nominating Election hereinafter referred to in this chapter as the “Commission.”

(c) The Fund shall be administered by the Director of the Office of Administrative and Research Services. All expenditures from the Fund

shall be authorized by the Commission and shall be subject to audit by the Controller. All contracts which involve any expenditure from the Fund shall be subject to review and approval by the City Attorney.

(d) All gifts, contributions and bequests to the Commission for the purposes set forth in this chapter which exceed the sum of $5,000 in value shall be submitted to the City Council for acceptance or rejection. All gifts, contributions and bequests which do not exceed the sum of $5,000 in value shall be submitted to the Commission for acceptance or rejection. All gifts, contributions and bequests, whether accepted by the City Council or the Commission, and all monies, whether appropriated by the City Council or received from any other source, for the purposes set forth in this chapter shall be placed in the Fund.

(e) The Director of the Office of Administrative and Research Services shall inform the Controller of any special terms or conditions placed upon the use of all monies accepted for deposit in the Fund. The Controller shall establish a separate account in the Fund for each use for all accepted monetary gifts, contributions or bequests which contain any special term or condition. No money shall be expended from the Fund except in compliance with each special term or condition under which such money was accepted. Any request for an expenditure of money from any such separate account shall be accompanied by sufficient information for the Controller to determine that the proposed expenditure would not contravene the specific use for which such separate account was established.

(f) All monies accepted for deposit in the Fund without special terms or conditions upon their use shall be placed in a general account established in the Fund by the Controller.

(g) All interest and other earnings attributable to monies in the Fund shall be credited to each account in the Fund to which they are attributable and shall be devoted to the purposes thereof.

(h) Each offer of a gift or bequest of property or the use thereof and any offer of services to be utilized by the Commission which exceeds $5,000 in value shall be submitted to the City Council for acceptance or rejection. Each such offer which does not exceed $5,000 in value shall be submitted to the Commission for acceptance or rejection.

(i) The Director of the Office of Administrative and Research Services shall report to the City Council and Mayor regarding the Fund on an annual basis within 90 days after the close of the City’s fiscal year. Such report shall identify all receipts into the Fund, including their sources, and all expenditures out of, the Fund, including the purposes for which the expenditures were made. Such report shall also include gifts and bequests accepted under the provisions of Subsection (h) hereof.

(j) The Fund shall cease to exist after June 30, 1999.
