Sec. 5.329. Creation and Administration of the Fund.¶
(a) There is hereby created and established within the Treasury of the City of Los Angeles a special trust fund to be know as “The Homeless Shelter and Assistance Trust Fund” hereinafter referred to as the “Fund.”
(b) The Fund shall be used to provide assistance for the homeless in the City of Los Angeles to find shelter and other related services or materials in the interest of public health and welfare.
(c) Any gift, contribution or bequest accepted by the City Council to further the purposes of the Fund, or money appropriated or received from any other source for said purpose shall be deposited into the Fund. All gifts, contributions or bequests of $500.00 or more shall be submitted to the City Council for acceptance or rejection. All gifts, contributions or bequests of less than $500.00 may be accepted or rejected by the City Clerk for deposit into the Fund.
(d) The Controller shall establish a separate account for each accepted gift, contribution or bequest which includes any special
requirements, qualifications or conditions for use. All accepted gifts, contributions or bequests which do not include any special requirements, qualifications or conditions for use shall be placed in a General Account within the Fund established by the Controller for this purpose.
(e) The Fund shall be administered by the City Clerk and any moneys expended therefrom shall be first approved and authorized by the Mayor and the President of the Council.

Sec. 5.331. Warner Center Air Quality Trust Fund.¶
A. There is hereby created within the Treasury of the City of Los Angeles a special fund known as the “ Warner Center Air Quality Trust Fund”, referred to in this chapter as “the Fund”, to be administered by the Department of City Planning in accordance with City practice and in compliance with Government Code Section 66000, et seq.
B. The Fund shall be used for the deposit of fees for the purposes of receiving and disbursing, as authorized, payments of the Construction Air Quality Impact Assessment (CAQIA) Fee collected by the Department of City Planning pursuant to Section 18 of the Warner Center Specific Plan.
C. The Department of City Planning shall collect payments derived from all commercial, industrial and the non-residential component of mixed use development projects in the Warner Center Specific Plan area, and remit these funds to the Treasury of the City of Los Angeles for deposit into “the Fund”. All interest and other earnings from money received into the Fund shall be credited to the Fund and devoted to the purposes set forth in this ordinance.
D. All monies from the Fund shall be expended only as provided in Section 18 of the Warner Center Specific Plan and for the sole purpose of mitigating each Project’s air quality impacts on either Canoga Park High School or Parkman Middle School, including reimbursing the School District for funds it expends to purchase and install existing and enhanced/upgraded air conditioning/filtration systems to mitigate the impacts of Projects in the Air Quality Impact Areas.
E. Expenditures shall be authorized by the Director of City Planning or the Director’s designee.
