2.38.210 - Personnel included.

A. The provisions of this chapter shall apply only to the following departments and employees of the city, excluding those set forth in subsections (B) and (C) of this section:

  1. Full-time regular positions of the police department;

  2. Full-time regular positions of the fire department;

  3. Full-time regular positions of the department of libraries;

  4. Full-time regular positions of the public works department;

  5. Full-time regular positions of the parks and recreation department;

  6. Full-time regular positions of the finance department;

  7. Full-time regular positions of the water and wastewater resources department;

  8. Full-time regular positions of the city clerk's office;

  9. Full-time regular clerical positions of the economic and community development department.

B. The provisions of this chapter shall not apply to executive management and other key management or administrative positions serving the above departments, including but not limited to:

  1. Department heads and assistant department heads;

  2. Division heads of the water and wastewater resources department;

  3. Administrative assistant(s) to any department head(s);

  4. The city engineer, assistant city engineer and associate/senior civil engineers;

  5. Positions of the senior services division;

  6. The city clerk and city treasurer.

C. The provisions of this chapter shall not apply to part-time, temporary, seasonal or other hourly employees.

2.38.220 - Additions to classified service personnel.

The city council may by ordinance add additional departments, appointive officers or employees to those enumerated and placed under the operation of the civil service system by Section 2.38.210. All employees and officers in the departments placed under the civil service system shall be deemed to be in the classified service of the city.

2.38.230 - Appointments to classified service.

All appointments to positions or employments in the classified service shall be made by the city manager, or by the officer in whom is vested by law the appointive power from the applications on file with the city in accordance with the rules and regulations adopted pursuant to Section 2.38.020. Any officer having such appointive power shall be designated as an appointing officer.

2.38.240 - Temporary appointments.

Temporary appointment to positions in the classified service may be made by the city manager or by an appointing officer of persons who do not possess the minimum standards or qualifications for office, whose applications have not been filed, or who have not been certified on an eligible list as a result of an examination in the event those who are eligible are not immediately available. Such temporary appointments shall not continue for longer than twelve months.
