2.02.010 - Office created—Appointment.

The office of city manager is created. The city manager shall be appointed by the city council solely on the basis of his or her executive and administrative qualifications.

2.02.020 - Tenure.

The city manager shall hold office during the pleasure of the city council.

2.02.030 - Eligibility of council members.

No person elected to membership in the city council shall, subsequent to such election, be eligible for appointment as city manager until two years shall have elapsed following the expiration of the last term to which he or she was elected.

2.02.050 - Absence of manager—Interim appointment.

In the absence of the city manager from the city or in the event of his or her temporary disability to perform the duties of the office, the city council may appoint some properly qualified person to perform the duties of the office of city manager.

2.02.070 - Powers and duties generally.

The city manager shall be the administrative head of the city government, but under the direction and control of the city council. He or she shall be responsible to the city council for the efficient administration of the affairs of the city which are under his or her jurisdiction. In addition to his or her general powers as administrative head, and not as a limitation thereof, it shall be the duty of the city manager and he or she shall have power to do the following:

A. See that all laws and this code or any other ordinances of the city are duly enforced;

B. Appoint, remove and demote any officers and employees of the city except the city clerk, city treasurer and city attorney. Such power will be subject to the provisions of Chapters 2.38 and 2.44;

C. Transfer employees from one department of the city to another where legally permissible, and where legally permissible, to consolidate and combine offices, positions, departments and units under his or her jurisdiction, with the consent of the city council;

D. Control, order and give directions to all heads of city departments and to subordinate officers and employees through their department head;

E. Attend all meetings of the city council unless excused therefrom by the city council;

F. Recommend to the city council for adoption such measures and ordinances as he or she may deem necessary or proper;

G. Keep the city council advised at all times as to the financial conditions and needs of the city;

H. Prepare and submit an annual budget and an annual salary survey to the city council for its approval;

I. Purchase all supplies for all departments and divisions of the city government;

J. Make investigations into the affairs of the city and each department and division thereof and make investigations with respect to all contracts and obligations to which the city is a party;

K. Investigate all complaints in relation to all matters concerning the administration of the government of the city, investigate the service required to be rendered by any public utility in the city and see that all provisions of franchises, permits and privileges granted by the city are faithfully observed;

L. Exercise general supervision over all public buildings, public parks, other public property which are under the control and jurisdiction of the city;

M. Devote his or her entire time during customary working hours to the duties and interest of the city;

N. Perform such other and additional duties and exercise such other and additional powers as may be reasonable, delegated to him or her by this code or any other city ordinances;

O. Attend all meetings of any of the city commissions or boards created by the city council upon his or her own volition or upon direction of the city council. At such meetings he or she shall be heard as to all matters upon which he or she wishes to address them;

To operate, manage and direct the affirmative action program of the city, which program shall not be part of the classified service of the city;

R. Signature Authority. The city manager, as well as a department head, is hereby authorized to execute documents as provided in California Government Code section 40602, whenever the city council has approved the execution by the city manager or department head by resolution, motion, minute order or other appropriate action.

2.02.080 - Entrustment of administrative service.

Except for the purposes of inquiry and recommendations with respect to policy, the city council and its members shall entrust the administrative service of the city wholly to the city manager.

2.02.090 - Relations with city council.

Neither the city council nor any member thereof shall give orders to any of the subordinates of the city manager. The city manager shall take his or her orders and instructions from the city council as a whole and no individual city councilman shall give any orders or instructions to the city manager.

2.02.100 - Compensation—Reimbursement for expenses.

The city manager shall receive such compensation and expense allowances as the city council shall from time to time determine and fix by resolution. Such compensation and expenses shall be a proper charge against such funds of the city as the city council shall designate. The city manager shall be reimbursed for all sums necessarily incurred or paid by him or her in the performance of his or her duties or incurred when traveling on business pertaining to the city under direction of the city council. Reimbursement shall only be made, however, when a verified itemized claim, setting forth the sums expended for such business for which reimbursement is requested, and has been presented to the city council for approval.

2.02.110 - Assistance of other city officers.

It shall be the duty of all subordinate officers and the city clerk, city treasurer and city attorney to assist the city manager in administering the affairs of the city efficiently, economically and harmoniously so far as may be consistent with their duties as prescribed by law, and this code or any other ordinances of the city.

2.02.120 - Removal from office.

The city manager may be removed by majority vote of the city council; however, the motion to remove a city manager shall be made at least ninety days prior to any vote thereon.
