2.20.010 - Personnel commission established.¶
A "personnel commission" for the city of Calexico is established. The rules and regulations set forth in Chapter 2.19 shall apply to this commission, except as otherwise required by state law. If there is any conflict or inconsistency between the provisions of this chapter and Chapter 2.19, the provisions of this chapter will control.

2.20.020 - Duties of the commission.¶
It shall be the duty of the personnel commission to hear appeals of city personnel regarding discipline, demotion or dismissal. It shall be the duty of each commissioner to attend all appeal hearings and to participate in the decisions of the commission.

2.20.030 - Powers of chairpersons.¶
The chairman or his/her designee, shall have the power to administer oaths; subpoena witnesses and materials; and to conduct the hearings.
The commission shall have the power to make any orders in conjunction with an appeal under its jurisdiction, including, but not limited to, affirming, overturning or modifying any previous administrative decision and order.
All decisions of the commission shall be by a majority vote. A quorum of three shall be required for the commission to conduct its hearings.
All decisions of the commission shall be final decisions of the city and shall be followed by the city unless overturned by the Superior Court or Courts of Appeal.
The commission may adopt guidelines for conducting administrative hearings regarding appeals. All appeals shall be conducted within the time limitations described in the respective employee memorandum of understanding, employee rules and regulations adopted by the city council, or as otherwise agreed to by the appealing employee and city.
All appeals shall be within the scope described for such appeals to the city council in this municipal code, adopted rules and regulations and memoranda of understanding. The establishment of this personnel commission is not intended to expand the scope of appeal described in the Calexico Municipal Code, adopted rules and regulations and respective memorandum of understanding. At the conclusion of any and all hearings, the personnel commission shall make a decision which shall include written findings of fact and which shall become the final decision for the city.

2.20.040 - Members appointed.¶
The personnel commission shall consist of five members. All appointments shall be made in accordance with Chapter 2.19 of this code, and any other applicable city council policies or determinations.

2.20.050 - Election of chairman of commission.¶
Annually, during the month of January, the commission shall elect a chairman and vice chairperson from its duly appointed membership who shall preside at the commission's hearings and meetings.
