Chapter 10.10 — COST RECOVERY FOR VEHICLE REMOVAL

10.10.010 - Purpose.

The provisions of this chapter are adopted in accordance with the determination made and the authority granted by the state of California under Section 22850.5 of the Vehicle Code to allow for the imposition of a charge equal to the city's administrative costs, relating to the removal, impound, storage or release of properly impounded vehicles in connection with the city's enforcement of the provisions contained in Section 14602.6 of the Vehicle Code.

10.10.020 - Scope.

The provisions of this chapter shall only apply to the registered owner or the agents of that registered owner and shall not include the following:

A.

Any vehicle towed pursuant to the abatement provisions contained in Chapter 10.56 of this code; or

B.

Any vehicle sold at a lien sale pursuant to Sections 3068.1 to 3074, inclusive of, and Section 22851 of the California Vehicle Code unless the sale proceeds are sufficient to pay both the lien holder's total charges and the city's administrative costs.

10.10.030 - Administrative costs.

The city council shall from time to time deter-mine and fix an amount to be assessed as administrative costs under this chapter, which amount shall be set by city council resolution at a fixed rate per vehicle in connection with the city's enforcement of the provisions contained in Section 14602.6 of the Vehicle Code. The administrative costs shall be collected by the city from the registered owner or the agents of that registered owner at the time of release.

10.10.040 - Waiver of administrative costs.

Upon request by the registered owner of the vehicle or the agents of that registered owner, the chief of police may grant a waiver of the administrative costs under this chapter where verifiable proof is presented to show that the vehicle in question was reported stolen at the time the vehicle was removed.
