Marin County Municipal Code Ch. 3.57 Bond Service Fees

3.57.010 - Treasurer pre-bond closing, paying agent, and bond service fees.

The treasurer shall be and is authorized to charge the following fees payable to the county of Marin for the actions outlined below:

  1. Pre-Bond Closing Fees. A one-time minimum fee of twenty dollars for each special assessment in a proceeding conducted under the Improvement Act of 1911 or the Municipal Improvement Act of 1913 up to a charge of not less than one thousand five hundred dollars to cover the actual costs of work provided by the county treasurer prior to the closing of bonds and their issuance for assessment proceedings as directed under the aforesaid Acts.

  2. Paying Agent Fees. Where the treasurer is designated as the paying agent under the Improvement Act of 1911, the Improvement Bond Act of 1915 or the Mello Roos Act, the following fees for administration shall apply:

(a) Improvement Act of 1911 Bonds: three hundred dollars per assessment with a minimum fee of not less than two thousand dollars. The fee shall be included in the engineer's report and paid in full upon closing.

(b) Improvement Bond Act of 1915 and the Mello Roos Act: the treasurer shall set the fee annually to cover actual costs. The treasurer shall provide an itemized report showing actual costs. The fee shall be reported to the auditor-controller for inclusion annually on the property tax roll under the authority of the Streets and Highways Code Section 8682.1.

3.57.020 - Basis for establishing fees.

The board finds that the fees specified by this chapter do not exceed the amounts reasonably necessary to cover the costs of the treasurer in administering special assessments under the Improvement Act of 1911, Improvement Bond Act of 1915 and the Mello Roos Act.
