This Ordinance may be amended by changing the boundaries of districts or by changing any other provisions thereof whenever the public necessity and convenience and the general welfare require such amendment by the procedure set forth in this Article. A. Initiation (1) By petition of one or more property owners affected by the proposed amendment, which petition shall be filed with the Planning commission or with the City Clerk on a form prescribed by the Planning Commission and shall be accompanied by a fee of $5.00 for the first lot or parcel or portion thereof, plus $1.00 for each additional lot or parcel or portion thereof, or
(2) By action by the City Council, or Ordinance No 306

(3) By section by the Planning Commission. B. Public Hearings (1) The Planning Commission shall hold a public hearing as required by law on any proposed amendments or change of district, and shall give notice thereof at least ten days prior to the date of hearing by mail to the owners of property within a radius of 250 feet of the exterior boundaries of the property involved in the proposed amendment or change of district, using for this purpose the last known name and address of such owners as shown upon the assessment rolls of the City. In addition, notice of hearing shall be posted in at least three public places with the City of Loyalton at least ten days prior to the date of hearing. (2) In case the proposed amendment consists of a change of the boundaries of any district so as to reclassify property from any district to any other district, the Planning Commission may give additional notice of the time and place of such hearings and of the purpose by posting public notices thereof not less than 10 days prior to the date of such hearing along the streets and roads upon which the property proposed to be reclassified abouts and in the vicinity thereof. (3) The above notices shall state the nature of the proposed amendment or change of district, the location of the property involved and the time and place of the hearing. (4) Failure of any property owner to receive the above notice or failure to post the public notices shall not invalidate any proceedings for the amendment of this Ordinance. C. Action by Planning commission Following the aforesaid hearing, the Planning Commission shall submit a report of its findings and a summary of all pertinent testimony heard at the hearing, together with its recommendations with respect to the proposed amendment or change of district to the City Council. D. Action by City Council Upon receipt of the report and recommendations of the Planning Commission, the City Council shall set the matter for public hearing in the same manner and giving notice thereof in the same manner as prescribed for hearings before the Planning Commission. Within 90 days from the date of receipt of the report and recommendations of the Planning Commission, the City Council shall adopt the proposed amendment or change of district or any part thereof or shall disapprove the recommendation of the Planning Commission.
