Words used in the present tense include the future tense, the singular includes the plural number, the plural number includes the singular number; the term “building” includes the term “structure;” the term “occupied” includes the term “designed or intended to be occupied;” the term “used” includes the term “arranged, designed or intended to be used.” The term “shall” is mandatory and not directory. The term “City Council” shall mean the City Council of the City of Loyalton, and “Planning Commission” shall mean the Planning Commission of the City of Loyalton. The work “City” shall mean the incorporated area of the City of Loyalton. ACCESSORY BUILDING: A detached subordinate building the use of which is incidental to that of the main building of the same lot, or to the use of the land. ACCESSORY USE: A use or building customarily incident to or subordinate to the principal use or building located upon the same lot. AFFECTED AREA: An area having a radius of 300 feet from a proposed change. ALLEY: A thoroughfare being a public way permanently reserved as a secondary means of access to abutting property. ALTERATIONS, STRUCTUAL: Any change in the supporting members of a building, such as bearing walls, columns, beams or girders. APARTMENT: A room or suite of rooms in an apartment house which room or suite of rooms is arranged, intended, designed and constructed or reconstructed to be occupied as a residence of a single family, individual, or group of individuals. APARTMENT HOUSE: Any building or portion thereof which is designed and built for occupancy by three or more families living independently. AUTOMOBILE WRECKING: The dismantling or wrecking of inoperative motor vehicles or trailers or the storage of dismantled or wrecked vehicles or parts. BASEMENT: A space partly or wholly underground and having more than one-half its height, measured from the floor to the finished ceiling below the average adjoining grade. If the finished floor level directly above a basement is more than six feet above grade at any point, such basement shall be considered a story. Ordinance No 306

BATHROOM: A room within the structure containing at least a washbasin and water closet, and a permanently installed tub or shower bath. BOARDING HOUSE: A dwelling in which regular meals for 3 or more persons are provided for a compensation or profit. BUILDING: Any structure having a roof supported by columns and/or walls and intended for the housing or shelter of any person, animal, or chattel. BUIDING AREA: The maximum horizontal projected area of a building and its appurtenant buildings, excluding open steps, buttresses, terraces, cornices, and other minor, ornamental features projecting from the walls of the building, not otherwise supported by the ground. BUILDING COVERAGE: The land area covered by the main building on a lot, including all projections except eaves. BUILDING HEIGHT: The vertical distance measured from the average level of the highest and lowest point of that portion of the lot covered by the building to the highest point of the roof, ridge or parapet wall. BUILDING LINE: Either the main foundation wall or the line of any covered porch extending outside the main foundation line, not including steps or walks, whichever is nearer the lot line in question. BUILDING SITE: The land area occupied or capable of being covered by the building or buildings permissible within the particular district and including required yards. BUSINESS OR COMMERCIAL: The purchase, sale or other transaction involving the handling or disposition of any article, substance or commodity for livelihood or profit, or the ownership or management of buildings, offices, recreational or amusement enterprises or the maintenance and use of offices by professions or trades rendering service. CAMPER COACH: Any device mounted on a truck or other vehicle which may be used as a dwelling or shelter on an occasional or semipermanent basis. CAMPER: A structure designed to be mounted upon a motor vehicle and to provide facilities for human habitation or camping purposes. CURB LINE: The elevated protective rim or edge of the street which physically separates the street from adjoining property; or that line at which a curb would be installed. DWELLING: A building designed for and/or occupied as a residence by one or more families. DWELLING GROUP: Two or more dwellings, other than a commercial tourist or motor court, located upon a building site, together with all open spaces required by this Ordinance. DWELLING, MULTIPLE FAMILY: A building designed and/or used to house three or more families, living independently of each other. DWELLING, SINGLE-FAMILY: A building designed for and/or occupied as a residence by one family. Ordinance No 306

DWELLING, TWO-FAMILY: A building designed and/or used to house not more than two families, living independently of each other. DWELLING UNIT: A building or part of a building designed for occupancy by one family. FAMILY: One person living alone, or two or more persons related by blood, marriage or legal adoption, or a group not exceeding five persons living together as a single housekeeping unit, and including domestic employees. GARAGE, COMMERCIAL: A building other than a private garage, used for the parking, repair or servicing of motor vehicles. GARAGE, PARKING: A public garage designed and/or used on a commercial basis for the storage of motor vehicles. GARAGE, PRIVATE: An accessory building or portion of a building, designed and/or used for the shelter or storage of automobiles by the occupants of the dwelling, including covered parking space or carport. GRADE OR GROUND LEVEL: The average of the finished ground level at the center of all walls of a building. GUEST HOUSE: Detached living quarters of a permanent type of construction without kitchen or cooking facilities, not to be leased or rented separately from the main building. HOME OCCUPATION: Any use customarily carried on within a dwelling by the inhabitants thereof, which use is incidental to the residential use of the dwelling and which use; (a) Involves no sales of merchandise other than that produced on the premises, or directly related to and incidental to the services offered. (b) Is carried on by the members of the family occupying the dwelling, with no other persons employed. (c) Produces no evidence of its existence beyond the premises such as noise, smoke, odors, vibrations, etc., except one sign not to exceed 2 square feet of area and pertaining directly to the particular home occupation. HOSPITAL: Any building or portion thereof used for the accommodation of and medical care of sick, injured or infirm persons, including sanitariums, nursing homes and boarding homes for the aged. HOTEL: A building designed for occupancy as the permanent or temporary living place of persons who are lodged with or without meals, and in which there are six or more guest rooms. INDUSTRIAL USE: The use of any parcel of land for the purpose of manufacturing, assembly, storage, transporting or producing of a product by one or more persons, whether self-employed or not, for retail or wholesale as opposed to ordinary commercial use. INTERSECTION: The junction of any two or more dedicated and accepted public streets and that area common to both. Ordinance No 306

JUNK YARD: An area, fenced or unfenced, used for the storage, sorting or processing of scrap metal, auto bodies, aircraft bodies, machinery, rags, pasteboard, scrap lumber or other salvageable materials. This definition shall not include the storage of wood neatly stacked, for normal fuel burning purposes. LOT: A subdivision of a block as shown by any recorded plat of an addition to, or subdivision of, the city; or any portion of land, whether plated or unplated, considered as a unit of property and described by mates and bounds; if one or more lots are built upon as a unit of property, they shall, for the purpose of this Ordinance, be considered as a single lot; and including all required yards and other open spaces and frontage as defined herein. LOT, CORNER: A lot located at the junction of two or more intersecting streets with a boundary line thereof bordering on each of such streets. The shortest of such street frontage shall constitute the front of the lot. LOT, DEPTH OF: The mean horizontal distance from the front line of the lot to the rear line thereof, measured in the general direction of its side lines. LOT, INSIDE: A lot other than a corner lot. LOT, LINE: The property line dividing a lot from a street, alley or another lot. LOT, THROUGH: An inside lot having frontage on two streets. LOT, WIDTH: The distance between side lot lines measured along the front line. NON-CONFORMING USE: A use of a parcel of land lawfully existing at the time this Ordinance became effective, which does not conform to the regulations contained in this Ordinance. MOBILE HOME: Any vehicle capable of being moved either by another vehicle or under its own power which is intended by the manufacturer for use as a more or less permanent dwelling and which is factory equipped with all sanitary facilities normal in a dwelling. MOBILE HOME PARK: Any area or tract of land where one or more mobile home lots are rented or leased or held out for rent or lease to accommodate mobilehomes used for human habitation. The rental paid for any such mobilehome shall be deemed to include rental for the lot it occupies. MOTEL: See TOURIST COURT OFF-STREET PARKING: Space set aside for temporary parking or standing of motor vehicles together with sufficient area to provide for safe ingress and egress. OUTDOOR ADVEDRTISING: Any outdoor display of advertising material in any form upon any physical structure or natural object. PUBLIC USE: Any use which is for the benefit of one or more persons, the land for which is held in public or quasi-public ownership or control including parks, playgrounds, schools, cemeteries and public buildings. SERVICE STATION: A retail business establishment supplying motor fuel and oil and minor accessories and services for motor vehicles. Ordinance No 306

SET BACK LINES: A line established by this or other ordinances to govern the placement of buildings with respect to streets and alleys. SIGN: Any card, paper, wooden, metal, plastic or painted sign or any character over one foot square, placed for out door advertising purposes on any tree, wall, bush, rock building structure, or thing publicly or privately owned. Sign does not include official notices issued by any court or posted by any public officer or person in the performance of a public duty; or any warning or informational signs or structures required or authorized by City, County, State, or Federal officials. STABLE, COMMERCIAL: A stable for horses to be let, hired or used on a commercial basis. STABLE, PRIVATE: A stable for horses to be used by the owners thereof. STORY: That portion of a building between any floor and the surface of the floor next, above, or if there by no floor above it, then the space between its floor and the ceiling next above it. STREET: A public or permanent private way which offers a primary means of access to property. STRUCTURE: Anything constructed or erected upon the ground or attached to a structure have location on the ground. STRUCTIONAL ALTERATION: Any change in the supporting members of a building, such as bearing walls, columns, beams or girders and floor joists, ceiling joists or roof rafters. TOURIST COURT OR HOTEL: A group of attached or detached buildings containing individual sleeping or living units designed for or used temporarily by tourists or transients with garage or parking space conveniently located to each unit. TRAILER: A vehicle designed, equipped and/or used as a dwelling or for living or sleeping purposes. TRAILER COURT: A lot or parcel of land used or designed or intended to be used for accommodation of two or more trailers. TRAILER RESIDENTIAL LOT: A lot, the principal use of which is the location of a mobilehome, and used for dwelling purposes. TRAILER SITE: A location for one trailer in a trailer park permanently or temporarily occupied. USE: The purpose for which land or a building or buildings are designed, arranged or intended, and for which they may be occupied or maintained. YARD: Land unoccupied or unobstructed by structures, except for such encroachments as may be permitted by this Ordinance, bordering a building site. YARD, FRONT: A yard extending across the full width of the lot measured at right angles from the street line to the nearest permissible line of a main building or enclosed or covered porch. The front yard of a corner lot is the yard adjacent to the shorter street frontage. Ordinance No 306

YARD, REAR: A yard extending between the side yards of the lot, and measured at right angle from the rear line of the lot to the nearest permissible rear line of a main building or enclosed or covered porch. YARD, SIDE: A yard on either side of the lot extending from the front yard to the rear lot line, the width of each yard being measured between the side line of the lot and the nearest permissible line of the main building or enclosed or covered porch.
