Use permits, which may be revocable, conditional, or valid for a specified period of time, may be
issued by the Planning Commission for any of the uses or purposes for which such permits are required
by the terms of this ordinance, to permit public utility or service uses, public schools, libraries, and other
similar uses in any zone, when necessary for the public convenience and welfare, and to permit the
removal of natural materials, including building and construction materials, in any zone.
A.
Application and Fee
(1)
Application for use permit shall be directed to the Planning Commission and
submitted to the City Clerk together with a fee of $5.00, no part of which shall be returnable to
the applicant.
(2)
Such application shall be in writing on a form prescribed by the Planning
Commission and shall be accompanied by plans and elevations necessary to show details of the
proposed use or building.
(3)
The City Clerk, within three days after receipt of the application, shall forward
the same to the Planning Commission.
B.
PUBLIC HEARINGS
(1)
The Planning Commission shall hold at least one public hearing upon the
question of whether to grant or deny the application for a Use Permit. Notice of such hearing
shall be given by mail to all property owners within five hundred fifty feet of or adjacent to he
applicant’s property stating a brief description of the property, the proposed use, and the time
and place of the hearing. Such notice shall be mailed at least ten days prior to the hearing.
Failure of any property t receive such notice shall not invalidate the proceedings. In addition,
notice of the hearing shall be posted in at least three public places within the City of Loyalton.
C.
Action by the Planning Commission: No use permit shall be issued unless the Planning
Commission finds that the establishment, maintenance, or operation of the use or building applied for,
will not, under the circumstances of the particular case, be detrimental to the health, safety, peace,

morals, comfort and general welfare of persons residing or working the neighborhood of such proposed use, or will not be detrimental or will not be injurious to property and improvements in the neighborhood or the general welfare of the City. D. Revocation In any case where the conditions to the granting of a use permit have not been, or are not, complied with, the Planning Commission shall give notice to the permittee of intention to revoke such permit at least ten days prior to a hearing thereon. Following such hearing the Planning Commission may revoke such permit. E. Appeal Appeal from any finding of the Planning Commission may be made in writing to the City Council within ten days from the date of Commission’s action.
